Publicat la 17 iunie 2024 SEGUNDA SECȚIUNE Cererea nr. 35316/22 Gürkan İSTEKLI împotriva Türkiye și a altor 3 cereri (a se vedea lista anexată) comunicată la 27 mai 2024 OBIECTUL CAUZEI Toate cererile enumerate mai jos (a se vedea apendicele) se referă la condamnările penale ale reclamanților la condamnările penale, combinate cu o măsură de suspendare a pronunțarii hotărârii cu privire la acuzațiile de difuzare a propagandei în favoarea unei organizații ilegale în temeiul articolului 7 § 2 din Legea nr. 3713 și de participare la reuniuni și demonstrații ilegale în temeiul articolului 28 § 1 din Legea nr. 2911. În baza articolelor 10 și 11 din Convenție, reclamanții se plângeau de condamnările lor și de aplicarea ulterioară a unei măsuri de suspendare a hotărârii pentru actele și declarațiile lor presupuse legate de utilizarea libertății de exprimare și a libertății de adunare pașnică.

A existat vreo ingerință în dreptul reclamanților la libertatea de exprimare și/sau la adunarea pașnică în sensul articolului 10 § 1 și § 1 din Convenție, datorită condamnării lor la condamnarea condamnării la închisoare, combinată cu o măsură de suspendare a pronunțarii hotărârii? SUBJECT MATTER OF THE CASE

All the applications listed below (see appendix) concern criminal convictions of the applicants to prison sentences combined with a measure of suspension of the pronouncement of the judgment on charges of disseminating propaganda in favour of an illegal organisation under Article 7 § 2 of Law no. 3713 and participating in unlawful meetings and demonstrations under Article 28 § 1 of Law no. 2911. Relying on Articles 10 and 11 of the Convention, the applicants complained about their convictions and the subsequent application of a measure of suspension of the pronouncement of the judgment for their acts and statements allegedly related to their use of freedom of expression and freedom of peaceful assembly.

QUESTIONS TO THE PARTIES

Has there been an interference with the applicants’ right to freedom of expression and/or peaceful assembly within the meaning of Article 10 § 1 and 11 § 1 of the Convention, due to their conviction to prison sentences combined with a measure of suspension of the pronouncement of the judgment? If so, was that interference in accordance with the law and necessary in terms of Article 10 § 2 and/or Article 11 § 2?
