CINTIMEA SECȚIUNE Cerere nr. 28361/12 M.A. împotriva Suediei depusă la 11 mai 2012 DECLARAREA FACTELOR Reclamantul este un național afgan care s-a născut în 1995 și este în prezent în Suedia. El este reprezentat în fața Curții de către dl Sören Svensson, paznic ad litem pentru solicitant. Autoritățile suedeze și-au ordonat transferul, în conformitate cu Regulamentul Dublin, înapoi în Italia. COMPLAINTĂ Reclamantul se plânge în temeiul articolelor 2 și 3 din Convenție că, dacă ar fi fost transferat din Suedia în Italia, ar avea un risc real de a fi tratat rău de către poliția italiană și forțat să trăiască pe străzi. Mai mult, susține că se află în sănătate mentală slabă și suicidă. În sfârșit, el susține că ar risca să fie trimis în Afganistan sau Iran fără a-și examina cererile de azil de către autoritățile italiene.

The applicant is an Afghan national who was born in 1995 and is currently in Sweden. He is represented before the Court by Mr
Sören
Svensson, guardian
ad litem
for the applicant. The Swedish authorities have ordered his transfer, in accordance with the Dublin Regulation, back to Italy.
The applicant complains under Articles 2 and 3 of the Convention that, if he were transferred from Sweden to Italy, he would face a real risk of being ill-treated by the Italian police and forced to live on the streets. He further claims that he is in poor mental health and suicidal. Lastly, he claims that he would risk being sent to Afghanistan or Iran without having his asylum claims examined by the Italian authorities.
In the light of the applicant’s claims and the documents which have been submitted, would he face a risk of
being subjected to treatment in breach of Article 3 of the Convention if the transfer order to Italy were enforced?
