MINKAIROV împotriva Ucrainei și a altor 9 cereri (a se vedea tabelul apendice) Curtea Europeană a Drepturilor Omului (A Cincea Secțiune), ședința la 13 iunie 2024 ca comitet al comitetului compus din: Carlo Ranzoni , Președintele Mārtiδš Mits, María Elósegui , judecători și Viktoriya Maradudina, grefierul adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere observațiile prezentate de guvernul contestat și observațiile prezentate în răspuns de solicitanți, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților este stabilită în tabelul adăugat. Reclamațiile reclamanților în temeiul articolului 6 § 1 din Convenție privind lipsa de imparțialitate a tribunalului, având în vedere absența partidului judecător în procedurile de infracțiune administrativă au fost comunicate guvernului ucrainean („Guvernul”). Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. În prezentele cereri, după examinarea tuturor informațiilor de față, Curtea consideră că, din motivele menționate mai jos, plângerile privind presupusa lipsă de imparțialitate a tribunalului în cadrul procedurii de infracțiune administrativă impugnate sunt inadmisibile. În special, Curtea constată că imparțialitatea instanțelor interne nu a fost pusă în discuție în cadrul testelor subjective sau obiective și că reclamanții nu au semnat nicio circumstanță specifică care ar putea determina Curtea să se îndoiască de imparțialitatea instanțelor interne (a se vedea Figurka c. Ucraina , nr. 28232/22, § 30-44, 16 noiembrie 2023). În consecință, nu se poate considera că instanța internă a asumat rolul unei părți judecătorești sau a fost pusă într-o poziție care le impune să ia rolul unei părți judecătorești, subminând astfel imparțialitatea lor sau echitatea procedurii. Având în vedere cele de mai sus, Curtea constată că aceste plângeri sunt manifestamente nefondate și trebuie respinse în conformitate cu art. 3 și 4 din Convenție. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; declară că cererile sunt inadmisibile. Adoptate în limba engleză și notificate în scris la 4 iulie 2024. Having deliberated, decides as follows:
FACTS AND PROCEDURE

The list of applicants is set out in the appended table.
2.
The applicants’ complaints under Article 6 § 1 of the Convention concerning the lack of impartiality of the tribunal in view of the absence of the prosecuting party in administrative-offence proceedings were communicated to the Ukrainian Government (“the Government”).

Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
Complaints under Article 6 § 1 of the Convention (lack of impartiality of the tribunal in view of the absence of the prosecuting party in administrative-offence proceedings)

In the present applications, having examined all the material before it, the Court considers that for the reasons stated below, the complaints about the alleged lack of impartiality of the tribunal in the impugned administrative-offence proceedings are inadmissible.

In particular, the Court notes that the impartiality of the domestic courts was not called into question under either the subjective or the objective tests and that the applicants did not point to any specific circumstances which could cause the Court to doubt the domestic courts impartiality (see
Figurka v. Ukraine
, no. 28232/22, § 30-44, 16 November 2023).

Consequently, it cannot be considered that the domestic courts took the role of a prosecuting party or were put in a position requiring them to take the role of a prosecuting party, thereby undermining their impartiality or the fairness of the proceedings.

In view of the above, the Court finds that these complaints are manifestly ill-founded and must be rejected in accordance with Article
35
§§
3 and
4 of the Convention.
For these reasons, the Court, unanimously,
Decides
to join the applications;
Declares
the applications inadmissible.
