Rzayev împotriva Azerbaidjanului

Publicat la 8 iulie 2024 PRIMEA SECȚIUNE Cerere nr. 1323/23 Hasangulu RZAYEV împotriva Azerbaidjanului și alte 10 cereri (a se vedea lista anexată) comunicată la 17 iunie 2024 OBIECTUL CAUZEI Prezenta cerere se referă la legalitatea interdicțiilor de călătorie impuse de autoritățile interne reclamanților în cadrul diferitelor proceduri penale în care nu au fost condamnate, acuzate sau suspectate și la disponibilitatea unui remediu intern eficace la dispoziția acestora în acest sens. A fost pusă vreo restricție asupra libertății reclamanților de a părăsi teritoriul statului contestat, astfel cum este garantat de art. 2 § 2 din Protocolul nr. 4 la Convenție? Dacă este cazul, această restricție a fost în conformitate cu legea și necesară în conformitate cu art. 2 § 3 din Protocolul nr. 4 la Convenție?

Toate cererile cu excepția nr. 8938/24: Reclamanții au la dispoziția lor un remediu intern eficace pentru plângerile lor în temeiul articolului 2 din Protocolul nr. 4 la Convenție, astfel cum este prevăzut la art. 13 din Convenție?

SUBJECT MATTER OF THE CASE

The present applications concern the lawfulness of travel bans imposed by the domestic authorities on the applicants within the framework of various criminal proceedings in which they were not convicted, accused or suspected persons and the availability of an effective domestic remedy at their disposal in that connection.

QUESTIONS TO THE PARTIES

All applications: 1. Was any restriction placed on the applicants’ freedom to leave the territory of the respondent State, as guaranteed by Article 2 § 2 of Protocol No. 4 to the Convention? If so, was that restriction in accordance with the law and necessary in terms of Article 2 § 3 of Protocol No. 4 to the Convention? All applications except no. 8938/24: 2.
