Komarov și alții împotriva Rusiei

SECȚIUNEA III CAUZA DE KOMAROV ȘI ALȚII v. RUSSIA (Aplicații nos. 59242/19 și 50 altele – a se vedea lista adăugată) JUDGMENT STRASBOURG 4 iulie 2024 Această hotărâre este finală, dar poate fi supusă revizuirii editoriale. În cazul Komarov și alții v. Rusia, Curtea Europeană a Drepturilor Omului (A treia secțiune), ședința în calitate de comitet compus din: Peeter Roosma , Președintele Ioannis Ktistakis, Andreas Zünd , judecători și Viktoriya Maradudina, secretar adjunct al secțiunii interioare, după ce a deliberat în privat la 30 mai 2024, pronunță următoarea hotărâre, care a fost adoptată la data respectivă: PROCEDURA Cazul a fost originat în cererile împotriva Rusiei depuse la Curte în temeiul articolului 34 din Convenția pentru Protecția Drepturilor Omului și a Libertăților Fundamentale („Convenția”) privind diferitele date indicate în tabelul adăugat.

Guvernul Rus („Guvernul”) a fost anunțat de cereri. FACTE Lista reclamanților și detaliile relevante ale cererilor sunt prezentate în tabelul adăugat. Reclamanții se plângeau de închiderea lor într-o cușcă de metal în sala de judecată în timpul procedurii penale împotriva acestora. Unii reclamanți au formulat și alte plângeri în temeiul dispozițiilor Convenției. HOTĂRÂREA PRIVIND DECIZII Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o hotărâre unică. Jurisdicția Curții observă că faptele care dau naștere la presupusele încălcări ale Convenției au avut loc înainte de 16 septembrie 2022, data la care Federația Rusă a încetat să fie parte la Convenție.

Prin urmare, Curtea decide că este competentă să examineze prezentele cereri (a se vedea Fedotova și alții c. Rusia [GC], nr. 40792/10 și altele §§§§/10, 73, 17 ianuarie 2023). ALLEGAT VIOLAREA ARTICOLE 3 și 13 A CONVENȚIEI din cauza izolarei într-o cușcă de metale în sala de judecată Reclamanții se plâng în principal de izolare într-o cușcă de metale în sala de judecată în timpul procedurii penale împotriva lor. Ei se bazează pe art. 3 din Convenție. Unele reclamanți se plângeau de asemenea că nu aveau un remediu intern eficace în ceea ce privește grija în temeiul articolului 3, în contravenție cu art. 13 din Convenție. Curtea constată că reclamanții au fost păstrați într-o cușcă de metal în sala de judecată în contextul procesului lor.

În principalele cazuri de Svinarenko și Sliadnev c. Rusia [GC], nr. 32541/08 și 43441/08, CEHR 2014 (extracte) și Vorontsov și alții v. Rusia, nr. 59655/14 și altele 2 din 31 ianuarie 2017, Curtea a abordat deja problema utilizării cuștilor metalice în sala de judecată și a constatat că o astfel de practică constituie în sine un afront pentru demnitatea umană și constituie tratament degradant interzis de art. 3 din convenție. După examinarea tuturor materialelor care i-au fost prezentate, Curtea nu a constatat niciun fapt sau argument care să-l convingă să ajungă la o concluzie diferită cu privire la admisibilitatea (a se vedea, de asemenea, prelungirea de trei luni introdusă prin decizia președintelui Curții în 2020 ca urmare a blocajului impus în Franța din cauza pandemiei COVID 19 (a se vedea Saakashvili c. Georgia) (dec.), nr. 6232/20 și 22394/20, §§ 46-59, 1 martie 2022) și meritul acestor plângeri.

Având în vedere jurisprudența sa în cauză, Curtea consideră că, în cazul instantaneu, închiderea reclamanților într-o cușcă de metal în fața instanței în timpul procedurii penale împotriva acestora a constituit tratament degradant. 10. Prin urmare, aceste plângeri sunt admisibile și dezvăluie încălcarea articolului 3 din Convenție. 11. Având în vedere concluziile de mai sus în temeiul articolului 3 din Convenție, Curtea consideră că nu este necesar să se ocupe separat de plângerile reclamanților în temeiul articolului 13 din Convenție (pentru o abordare similară, a se vedea Valyuzhenich c. Rusia , nr. 10597/13, § 27, 26 martie 2019). ALTE VIOLĂȚI ALEGATE ÎN CAUZA BON ESTABILIZATĂ 12. Unii solicitanți au prezentat alte plângeri care au suscitat, de asemenea, probleme în temeiul Convenției, având în vedere jurisprudența relevantă a Curții (a se vedea tabelul adăugat).

Aceste plângeri nu sunt întemeiate în mod evident în sensul art. (a) din Convenție, și nu sunt inadmisibile pe niciun alt motiv, în consecință, trebuie să fie declarate admisibile. După examinarea tuturor informațiilor de dinaintea acestuia, Curtea concluzionează că, de asemenea, acestea dezvăluie încălcări ale Convenției în lumina jurisprudenței sale bine stabilite (a se vedea Idalov v. Rusia [GC], nr. 5826/03, §§§ 103 08, 22 mai 2012, și Tomov și alții c. Rusia , nr. 18255/10 și altele 5, §§ 92-156, 9 aprilie 2019, privind condițiile de transport inadecvate și lipsa unui remediu eficace în acest sens.

APLICAREA ARTICOLULUI 41 ALE CONVENȚIEI 13. Respectând documentele în posesia sa și jurisprudența sa (a se vedea, în special, Vorontsov și alții, Curtea consideră că constatarea unei încălcări în cererea nr. 3457/21 va constitui în sine o satisfacție suficientă (a se vedea Ivanov și alții c. Rusia [Comitetul], nr. 44363/14 și altele 2 § 12, 4 iunie 2020, și Puzanov c. Rusia [Comitetul], nr. 26895/14 și 2 alte cereri, § 13, 15 Septembrie 2022). În plus, consideră rezonabil atribuirea sumelor indicate în tabelul adăugat celorlalți solicitanți.

Pentru aceste motive, TRIBUNALUL, UNANIMOUS, decide să se alăture cererilor; deține competența de a face față acestor cereri, deoarece se referă la faptele care au avut loc înainte de 16 septembrie 2022; Declară cererile admisibile; Deține că aceste cereri dezvăluie o încălcare a articolului 3 din Convenție din cauza plasării reclamanților într-o cușcă de metal în fața instanței în timpul procedurii penale împotriva acestora; deține că a existat o încălcare a convenției în ceea ce privește celelalte plângeri formulate în temeiul jurisprudenței bine stabilite a Curții (a se vedea tabelul anexat); faptul că nu este necesar să se ocupe separat de plângerile reclamanților în temeiul articolului 13 din Convenție referitoare la lipsa unui remediu intern eficace pentru a se plânge de plasarea într-o cușă de metal în sala de judecată; deține că constatarea unei încălcări constituie, în sine, o satisfacție suficientă pentru daunele nepecuniare suportate de solicitant în cererea nr. 3457/21; (a) faptul că statul contestat trebuie să plătească celorlalți solicitanți, în termen de trei luni, sumele indicate în tabelul adăugat, care urmează să fie convertite în moneda statului contestat la rata aplicabilă la data decontare;

(b) că de la expirarea celor trei luni menționate mai sus până la decontarea dobânzilor simple se achită pe sumele de mai sus la o rată egală cu rata de creditare marginală a Băncii Centrale Europene în timpul perioadei de incumpărare plus trei puncte procentuale. OTHER ALLEGED VIOLATIONS UNDER WELL-ESTABLISHED CASE-LAW

12. Some applicants submitted other complaints which also raised issues under the Convention, given the relevant well-established case-law of the Court (see the appended table). These complaints are not manifestly ill ‑ founded within the meaning of Article 35 § 3 (a) of the Convention, nor are they inadmissible on any other ground. Accordingly, they must be declared admissible. Having examined all the material before it, the Court concludes that they also disclose violations of the Convention in the light of its well-established case-law (see Idalov v. Russia [GC], no. 5826/03, §§ 103 ‑ 08, 22 May 2012, and Tomov and Others v. Russia , nos. 18255/10 and 5 others, §§ 92-156, 9 April 2019, concerning inadequate conditions of transport and the lack of an effective remedy in that respect).

41 OF THE CONVENTION

13. Regard being had to the documents in its possession and to its case ‑ law (see, in particular, Vorontsov and Others, cited above), the Court considers that the finding of a violation in application no. 3457/21 will constitute in itself sufficient just satisfaction (see Ivanov and Others v. Russia [Committee], nos. 44363/14 and 2 others, § 12, 4 June 2020, and Puzanov v. Russia [Committee], nos. 26895/14 and 2 other applications, § 13, 15 September 2022). It further finds it reasonable to award the sums indicated in the appended table to the remaining applicants.

FOR THESE REASONS, THE COURT, UNANIMOUSLY, Decides to join the applications; Holds that it has jurisdiction to deal with these applications as they relate to facts that took place before 16 September 2022; Declares the applications admissible; Holds that these applications disclose a breach of Article 3 of the Convention on account of the applicants’ placement in a metal cage before the court during the criminal proceedings against them; Holds that there has been a violation of the Convention as regards the other complaints raised under the well-established case-law of the Court (see the appended table); Holds that it is not necessary to deal separately with the applicants’ complaints under Article 13 of the Convention related to the lack of an effective domestic remedy to complain about placement in a metal cage in courtrooms; Holds that the finding of a violation constitutes in itself sufficient just satisfaction for the non-pecuniary damage sustained by the applicant in application no. 3457/21; Holds (a) that the respondent State is to pay the remaining applicants, within three months, the amounts indicated in the appended table, to be converted into the currency of the respondent State at the rate applicable at the date of settlement;

(b) that from the expiry of the above-mentioned three months until settlement simple interest shall be payable on the above amounts at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. Done in English, and notified in writing on 4 July 2024, pursuant to Rule 77 §§ 2 and 3 of the Rules of Court.
