SEGUNDA SECȚIUNE DECIZIE Nr. 76064/11 Ramazan VAROL împotriva Turciei și a altor 29 de cereri (a se vedea lista anexată) Curtea Europeană a Drepturilor Omului (a doua secțiune), care așezează la 17 septembrie 2013 în calitate de comitet compus din: Peer Lorenzen, președinte, András Sajó, Nebojša Vučinić, judecători și Atilla Nalbant, grefierul adjunct al secțiunii interioare; Având în vedere cererile de mai sus, indicate în apendice, după deliberare, hotărăsc după cum urmează: FACTE O listă a reclamanților este prezentată în apendice. În plus, numărul de caz și numărul de decizie al procedurii impuzate apar în apendice. Circumstanțele cazului Faptele cazului, astfel cum sunt prezentate de solicitanți, pot fi rezumate după cum urmează.

În diferite date, reclamanții au inițiat acțiuni în fața instanțelor civile sau a procedurilor civile au fost îndreptate împotriva lor în fața instanțelor civile. Procedurile au durat mai multe ani. Legea internă relevantă O descriere a dreptului intern relevant poate fi găsită în Müdür Turgut și alții ((dec.), nr. 4860/09, §§§ 19-26, 26 martie 2013 COMPLAINTS Reclamanții se plângeau în temeiul articolului 6 § 1 din Convenție că procedurile în fața instanțelor naționale nu au fost încheiate într-un timp rezonabil. Unele solicitanți au susținut, de asemenea, o încălcare a articolului 1 din Protocolul nr. 1 la Convenție. În primul rând, Curtea consideră că, în conformitate cu art. 42 § 1 din Regulamentul Curții, cererile ar trebui să fie însoțite, având în vedere similaritatea faptelor și a chestiunilor juridice susținute.

II. ÎNCĂLCAREA ALEGATĂ A ARTICOLUL 6 § 1 DE CONVENȚIE Reclamanții se plânge că durata procedurii este incompatibilă cu cererea de „tempă rezonabilă”, prevăzută la art. 6 §§ 1 din Convenție, care se citește după cum urmează: „În determinarea drepturilor și obligațiilor sale civile ... fiecare are dreptul la o ... audiere într-un timp rezonabil de către un ... tribunal ...” Curtea susține că reclamanții au afirmat că durata procedurii era incompatibilă cu principiul cerinței de „temps motivabil” în conformitate cu art. 6 § 1 din Convenție. În acest sens, Curtea a constatat în Müdür Turgut și alții (citată mai sus, §) 56) că Comisia de Compensare instituită prin Legea nr. 6384, în măsura în care este accesibilă și capabilă să ofere perspective rezonabile de remediere pentru plângeri privind durata procedurii constituie un remediu pe care reclamanții au fost obligați să-l epuizeze în sensul articolului 35 § 1 din Convenție.

În prezent, Curtea nu consideră niciun motiv să ajungă la o concluzie diferită. În consecință, aceste plângeri trebuie respinse în temeiul articolului 35 §§ §§ 1 și 4 din Convenție pentru neepuizare a căilor de recurs interne. III. ÎNCĂLCAREA ALEGATĂ A ARTICOLULUI 1 AL PROTOCOLULUI Nr. 1 A CONVENȚII Anumitor solicitanți au susținut în temeiul articolului 1 din Protocolul nr. 1 că sumele atribuite lor și-au pierdut valoarea din cauza lungii procedurii. Prin urmare, plângerile conexe în temeiul prezentului articol sunt prematuri și trebuie respinse pentru neepuizarea recourslor interne în temeiul articolului 35 §§ § 1 și 4 din Convenție.

DECISION Application no. 76064/11 Ramazan VAROL against Turkey and 29 other applications (see list appended) The European Court of Human Rights (Second Section), sitting on 17 September 2013 as a Committee composed of: Peer Lorenzen, President, András Sajó, Nebojša Vučinić, judges, and Atilla Nalbant, Acting Deputy Section Registrar, Having regard to the above applications, indicated in the appendix, Having deliberated, decides as follows: THE FACTS A list of the applicants is set out in the appendix. Additionally, the case and decision numbers of the impugned proceedings appear in the appendix. A. The circumstances of the case The facts of the case, as submitted by the applicants, may be summarised as follows.

On various dates, the applicants initiated actions before the civil courts or civil proceedings were brought against them before the civil courts. The procedures are lasting for several years. B. Relevant domestic law A description of the relevant domestic law may be found in Müdür Turgut and Others ((dec.), no. 4860/09, §§ 19-26, 26 March 2013 ). COMPLAINTS The applicants complained under Article 6 § 1 of the Convention that the proceedings before the national courts had not been concluded within a reasonable time. Certain applicants also alleged a violation of Article 1 of Protocol No. 1 to the Convention. I.

JOINDER OF THE APPLICATIONS

The Court first considers that in accordance with Rule 42 § 1 of the Rules of Court, the applications should be joined, given the similarity of the facts and of the legal issues raised. II.

ALLEGED VIOLATION OF ARTICLE 6 § 1 OF THE CONVENTION

The applicants complained that the length of the proceedings was incompatible with the “reasonable time” requirement, laid down in Article 6 § 1 of the Convention, which reads as follows: “In the determination of his civil rights and obligations ... everyone is entitled to a ... hearing within a reasonable time by a ... tribunal ...” The Court observes that the applicants asserted that the length of the proceedings was incompatible with the principle of the “reasonable time” requirement in accordance with Article 6 § 1 of the Convention. In that respect, the Court found in Müdür Turgut and Others (cited above, § 56) that the Compensation Commission established by Law no. 6384, insofar as it is accessible and capable of offering reasonable prospects of redress for complaints concerning the length of proceedings constituted a remedy which applicants were required to exhaust for the purposes of Article 35 § 1 of the Convention.

In the present cases, the Court sees no reason to come to a different conclusion. It follows that these complaints must be rejected under Article 35 §§ 1 and 4 of the Convention for non-exhaustion of domestic remedies. III. ALLEGED VIOLATION OF ARTICLE 1 OF PROTOCOL No. 1 OF THE CONVENTION Certain applicants claimed under Article 1 of Protocol No. 1 that the amounts awarded to them had lost their value due to the length of the proceedings. The Court observes that the civil proceedings against the applicants are still pending before the domestic courts. Therefore, the related complaints under this article are premature and must be rejected for non-exhaustion of domestic remedies pursuant to Article 35 §§ 1 and 4 of the Convention.

For these reasons, the Court unanimously Decides to join the applications; Declares the applications inadmissible.
