Comunicat la 4 iunie 2014 CIFTH SECȚIUNE Cererea nr. 37794/14 Aleksandr Iosifovich Nagorskiy împotriva Ucrainei depusă la 3 iunie 2014 DECLARAREA FACTELOR Reclamantul, dl Aleksandr Iosifovich Nagorskiy, este un național ucrainean, care s-a născut în 1967 și trăiește în Kyiv. Reclamantul este reprezentat în fața Curții de către dl A. Fedosov. Reclamantul susține că, la 8 mai, 2014 el a fost bătut de forțele speciale de poliție. El a primit mai multe răni pe cap, precum și alte răni. El a fost mai mult adus într-un spital unde el a primit primul ajutor. Reclamantul a afirmat în continuare că rănile sale nu au fost documentate în mod corespunzător, și că el nu a primit tratamentul medical relevant.

COMPLAINTE Reclamantul se plânge în temeiul articolului 3 din Convenția privind maltraturile pe care le-a suferit la 8 mai 2014. El se plânge în continuare de lipsa asistenței medicale. A fost suficient tratament medical și asistență prestată reclamantului în SIZO și a fost astfel de tratament compatibil cu cerințele articolului 3 din Convenție? În special, ce tratament medical a primit reclamantul începând cu 8 mai 2014? Având în vedere garanțiile procedurale prevăzute la art. 3 din Convenție, a fost efectuată o anchetă în acest caz de către autoritățile naționale?

STATEMENT OF FACTS

The applicant, Mr Aleksandr Iosifovich Nagorskiy, is a Ukrainian national, who was born in 1967 and lives in Kyiv. The applicant is represented before the Court by Mr A. Fedosov. The applicant submits that on the 8 May 2014 he was beaten by the police special forces. He received several wounds on his head, as well as other injuries. He was further brought to a hospital where he received the first aid. The applicant further states that his injuries were not properly documented, and that he did not receive the relevant medical treatment. COMPLAINTS The applicant complains under Article 3 of the Convention of the ill-treatment he suffered on the 8 May 2014. He further complains of lack of medical assistance.

QUESTIONS 1. Has the applicant been subjected to inhuman or degrading treatment on 8 May 2014, in breach of Article 3 of the Convention? 2. Was adequate medical treatment and assistance provided to the applicant in the SIZO, and was such treatment compatible with the requirements of Article 3 of the Convention? In particular, what medical treatment has the applicant been receiving since 8 May 2014? 3. Having regard to the procedural guarantees provided by Article 3 of the Convention, was an investigation conducted in the present case by the domestic authorities?
