Cazul de la decizia 16729/07 MRAMOR 02/10/2012 1154/07 Romano PETEK 15/04/2014 (Adoptat de Comitetul de Miniștri la 4 martie 2015 în cadrul celei de-a 1221-a ședințe a Deputaților Miniștrilor) Comitetul de Miniștri, în conformitate cu art. 39, punctul 4 din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor aranjamente prietenoase așa cum au apărut în hotărârile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere că, în aceste cazuri, Curtea a luat notă formală a aranjamentelor prietenoase atinse de guvernul statului acuzat și de reclamanții, și că s-a constatat că aranjamentele s-au bazat pe respectarea drepturilor omului astfel cum au fost definite în Convenția sau în Protocolul său, DLARES, de la art. 39, după cum urmează.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in these cases the Court, having taken formal note of the friendly settlements reached by the government of the respondent State and the applicants, and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided to strike these cases from its list;

Having satisfied itself that the terms of the friendly settlements were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close their examination.
