Cauza Data deciziei 11261/14 JOPITER SK S.R.O. 26/04/2016 1854/14 Martin HAVRIlik 29/03/2016 (Adoptat de Comitetul de Miniștri la 8 decembrie 2016 la ședința de 1273 rd a Deputaților Miniștrilor) Comitetul de Miniștri, în conformitate cu art. 39, punctul 4 din Convenția pentru Protecția Drepturilor Omului și Libertăților Fundamentale, care prevede că Comitetul supraveghează executarea unor aranjamente prietenoase după cum apar în hotărârile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere că, în aceste cazuri, Curtea a luat notă formală a aranjamentelor prietenoase atinse de guvernul statului reclamant și de reclamanți, și că s-a convins că aceste aranjamente au fost bazate pe respectarea drepturilor omului astfel cum au fost definite în Convenția sau în protocolul său, a decis să ia aceste cazuri din lista sarcina DEC.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in these cases the Court, having taken formal note of the friendly settlements reached by the government of the respondent State and the applicants, and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided to strike these cases from its list;

Having satisfied itself that the terms of the friendly settlements were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close their examination.
