Uzun și alții împotriva Turciei

SEGUNDA DECIZIE DECIZIE Nr. 25922/18 UZUN cu privire la Türkiye și 13 alte cereri (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (A doua secțiune), care așezează la 6 februarie 2025 ca comitet compus din: Gediminas Sagatys , Președintele Stéphane Pisani, Juha Lavapuro , judecători și Viktoriya Maradodina, grefier adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, după ce a deliberat, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților este stabilită în apendice. Reclamațiile reclamanților prezentate în temeiul dispozițiilor Convenției au fost comunicate Guvernului turc (“Guvernului”), care a prezentat observații cu privire la admisibilitatea și meritul.

Observațiile au fost transmise reclamanților, care au fost invitați să își prezinte propriile observații. Nu s-a primit răspuns la scrisorile Registrului. Prin scrisori, trimise prin post înregistrat la diferite date, reclamanții au fost notificați că perioada permisă pentru prezentarea observațiilor lor a expirat și că nu a fost solicitată prelungirea timpului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să continue cererea. Nu a fost primit niciun răspuns. DREPTUL având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie.

Având în vedere cele de mai sus și în absența unor circumstanțe speciale referitoare la respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererilor. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; hotărăște să scoată cererile din lista cazurilor sale.

DECISION Application no. 25922/18 Samet UZUN against Türkiye and 13 other applications (see appended table) The European Court of Human Rights (Second Section), sitting on 6 February 2025 as a Committee composed of: Gediminas Sagatys , President , Stéphane Pisani, Juha Lavapuro , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above applications lodged on the various dates indicated in the appended table, Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix. The applicants’ complaints raised under the provisions of the Convention were communicated to the Turkish Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicants, who were invited to submit their own observations. No reply was received to the Registry’s letters. By letters, sent by registered post on various dates, the applicants were notified that the period allowed for submission of their observations had expired and that no extension of time had been requested. The applicants’ attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application.

No response has been received. THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the applications. Accordingly, the applications should be struck out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
