A cincea secțiune DECIZIE Nr. 6937/08 Sergiy Leonidovych SHANIN împotriva Ucrainei Curții Europene a Drepturilor Omului (A Cincea Secțiune), care așeză la 19 octombrie 2017 în calitate de comitet compus din: Nona Tsotsoria, președinte, Gabriele Kucsko-Stadlmayer, Ltif Hüseynov, judecători și Liv Tigerstedt, grefier adjunct al secțiunii interioare; Având în vedere cererea depusă mai sus la data indicată în tabelul adăugat, având în vedere observațiile prezentate de guvernul contestat, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Detaliile relevante ale cererii sunt prezentate în tabelul adăugat. 13 din Convenția privind lungimea excesivă a procedurilor penale și lipsa oricărui remediu eficace în dreptul intern au fost comunicate guvernului ucrainean („Guvernului”).

Plaintele de drept în temeiul articolelor 6 § 1 și 13 din Convenție Curtea, după examinarea tuturor materialelor care i-au fost prezentate și având în vedere jurisprudența sa privind acest subiect (a se vedea, de exemplu, Merit v. Ucraina , nr. 66561/01, 30 martie 2004), consideră că plângerile reclamantului sub acest cap sunt inadmisibile deoarece durata procedurii nu a fost excesivă sau irezonabilă. Având în vedere cele de mai sus, Curtea constată că cererea este manifestament nefondată și trebuie respinsă în conformitate cu art. 35 §§ 3 și 4 din Convenție. Din aceste motive, Curtea declară în unanimitate cererea inadmisibilă.

FACTS AND PROCEDURE

The relevant details of the application are set out in the appended table. The applicant’s complaints under Articles 6 § 1 and 13 of the Convention concerning the excessive length of criminal proceedings and the lack of any effective remedy in domestic law were communicated to the Ukrainian Government (“the Government”). THE LAW Complaints under Articles 6 § 1 and 13 of the Convention The Court, having examined all the materials submitted to it and having regard to its case-law on the subject (see, for example, Merit v. Ukraine , no. 66561/01, 30 March 2004), considers that the applicant’s complaints under this head are inadmissible since the length of the proceedings was not excessive or unreasonable.

In view of the above, the Court finds that the application is manifestly ill-founded and must be rejected in accordance with Article 35 §§ 3 and 4 of the Convention. For these reasons, the Court, unanimously, Declares the application inadmissible. Done in English and notified in writing on 9 November 2017.
