Comunicat la 23 ianuarie 2018 SEGUNDA SECȚIUNE Cerere nr. 41053/17 Hüseyin KAHRAMAN împotriva Turciei și 14 alte cereri (a se vedea lista adăugată) OBJETOR DE CAUZĂ Cererea se referă la practica judiciară, în contextul procedurii de expropriare, pentru a ordona ambelor părți să plătească o sumă forfetară părții opozitoare în ceea ce privește taxele de avocat. Reclamanții se plâng că o astfel de pronunțare a scăzut indemnitatea de expropriare pe care le-a acordat-o, susținând că nu au responsabilitatea de inițiere a procedurii, deoarece instanțele au stat în favoarea lor și au hotărât să crească sumele propuse inițial de autoritatea publică expropriatoare. În baza articolului 1 din Protocolul nr. 1 la Convenție, reclamanții susțin că dreptul lor la bucuria pașnică a bunurilor lor a fost încălcat.

În special, faptul că reclamanții au fost condamnați să plătească taxe de avocat la autoritatea publică expropriată constituie o sarcină excesivă care a deturnat echilibrul echitabil care trebuie atins între interesul general al comunității și drepturile fundamentale ale persoanei fizice (a se vedea, mutatis mutandis Perdigão c. SUBJECT MATTER OF THE CASE

The application concerns the judicial practice, in the context of expropriation proceedings, to order both parties to pay a lump sum to the opposing party in respect of lawyer fees. The applicants complain that such an order decreased the expropriation indemnity awarded to them. They argue that they have no responsibility for the initiation of the proceedings, as the courts ruled in their favour and decided to increase the amounts initially proposed by the expropriating public authority. Relying on Article 1 of Protocol No. 1 to the Convention, the applicants allege that their right to peaceful enjoyment of their possessions was violated.

QUESTIONS tO THE PARTIES Have there been an interference with the applicants’ right to peaceful enjoyment of their possessions ? In particular, did the fact that the applicants were ordered to pay attorney fees to the expropriating public authority constitute an excessive burden which upset the fair balance which must be struck between the general interest of the community and the fundamental rights of the individual (see, mutatis mutandis , Perdigão v.
