Șengül și Nayman împotriva Turciei

Comunicat la 28 august 2018 SECȚIUNE Cerere nr. 61016/16 Hakime ȘENGÜL și alții împotriva Turciei depusă la 26 septembrie 2016 OBIECTUL CAUZĂRII Cererea se referă la răpirea și uciderea ulterioară a soțului primului reclamant și a tatălui celorlalți solicitanți, Abdülmecit Șengül. Reclamanții se bazează pe articolele 2, 6 și 13 din Convenție și se afirmă, în special, că nu a fost efectuată nicio investigație eficace privind răpirea și uciderea. Reclamanții au avut o „argumentare argumentată” de faptul că au existat o încălcare a drepturilor acestora în temeiul articolului 2 din Convenție?

Hotărârea Curții Constituționale a fost de a nu examina plângerile reclamanților cu privire la uciderea rudei lor din punctul de vedere al dreptului la viață – la care reclamanții menționați în mod expres în formularul de cerere prezentat la această instanță – este compatibilă cu obligația de a oferi un remediu eficace în sensul articolului 13 din Convenția citită în conjuncție cu art. 2 din Convenție? SUBJECT MATTER OF THE CASE

The application concerns the abduction and subsequent killing of the first applicant’s husband and the remaining applicants’ father Abdülmecit Șengül. The applicants rely on Articles 2, 6 and 13 of the Convention and allege, in particular, that no effective investigation was conducted into the abduction and killing. QUESTIONS tO THE PARTIES 1. Did the applicants have an “arguable claim” that there had been a violation of their rights under Article 2 of the Convention? 2. Was the decision of the Constitutional Court not to examine the applicants’ complaints concerning the killing of their relative from the standpoint of the right to life – to which the applicants expressly referred in the application form they submitted to that court – compatible with the obligation to provide an effective remedy within the meaning of Article 13 of the Convention read in conjunction with Article 2 of the Convention?
