Decizia nr. 8108/18 A.R.B. împotriva Țărilor de Jolien Schukking, judecători și Liv Tigerstedt, secretar adjunct al secțiunii interioare, având în vedere cererea depusă la 7 februarie 2018, După deliberare, decide după cum urmează: FACTE ȘI PROCEDIMENTUL Dl. A.R.B., este un național afgan care s-a născut în 1999. El a fost reprezentat de dna A.M. Veld, un avocat practicant în Drachten. Plângerile reclamantului în temeiul articolului 3 din Convenție, privind tratamentul la care se teme că va fi supus în cazul în care va fi returnat în Afganistan, au fost comunicate guvernului olandez („Guvernul”). După aceea, părțile au informat Curtea că reclamantul a primit un permis de ședere care îi permite să rămână în Țările de Jos. Guvernul a solicitat Curtea să atace cazul din lista sa de cazuri. Reclamantul s-a opus să fie atacat, deoarece dorește să primească compensații în ceea ce privește faptul că trăia injust pe stradă timp de 1,5 ani. DREPTUL Curții observă în primul rând că reclamantul nu mai confruntă cu riscul de a fi expulzat în Afganistan. În al doilea rând, acesta reiterează că art. 41 din Convenție îi permite să acorde satisfacție echitabilă „partidei lezive” numai dacă a constatat anterior că a existat o încălcare a Convenției sau a Protocolelor sale”, ceea ce nu a fost în acest caz. Având în vedere cele de mai sus, Curtea consideră că nu mai este justificat să continue examinarea cererii [art. 37 §§ §§ §§ §§ ) și că respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile de la aceasta, nu o impune să continue examinarea cererii (art. 37 § în amendă Prin urmare, cererea ar trebui eliminată din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri în conformitate cu art. 37 § 1 litera (c) din Convenție. FACTS AND PROCEDURE
The applicant, Mr A.R.B., is an Afghan national who was born in 1999. He was represented by Ms A.M. Veld, a lawyer practising in Drachten.
The applicant’s complaints under Article 3 of the Convention, concerning the treatment to which he feared he would be subjected if he were returned to Afghanistan, were communicated to the Dutch Government (“the Government”).
Subsequently, the parties informed the Court that the applicant had been granted a residence permit enabling him to stay in the Netherlands. The Government requested the Court to strike the case out of its list of cases. The applicant was opposed to the case being struck out as he wished to receive compensation in relation to the fact that he had unjustly been living on the streets for 1.5 years.
The Court firstly observes that the applicant no longer faces a risk of being expelled to Afghanistan. Secondly, it reiterates that Article 41 of the Convention allows it to award just satisfaction to the “injured party” only if it has previously “[found] that there has been a violation of the Convention or the Protocols thereto”, which it has not in this case.
In view of the above, the Court considers that it is no longer justified to continue the examination of the application (Article
37 §
1
(c)) and that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the application (Article
37 §
1
in fine
).
Accordingly, the application should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases in accordance with Article 37 § 1 (c) of the Convention.
