Decizia nr. 53746/18 Aleksandr Pavlovich KISELEV împotriva Rusiei Curtea Europeană a Drepturilor Omului (A treia secțiune), care a stat la 24 aprilie 2025 în calitate de comitet al comitetului compus din: Diana Kovatcheva , Președintele Úna Ní Raiheartaigh , Mateja δurović , judecători și Viktoriya Maradodina, grefier interimar, având în vedere cererea depusă la 9 ianuarie 2019, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTE Detaliile reclamantului sunt prezentate în tabelul adăugat. Plainele reclamantului în conformitate cu art. 3 din Convenție privind condițiile de detenție inadecvate în timpul transportului și lipsa unui remediu eficace în acest sens au fost comunicate guvernului rus („Guvernul”).

Reclamantul s-a plâns în temeiul articolelor 3 și 13 din Convenția privind condițiile de detenție în timpul transportului între 20 ianuarie 2016 și 18 decembrie 2017 și lipsa unui remediu eficace în acest sens. Curtea constată că, având în vedere jurisprudența sa bine stabilită cu privire la această chestiune (a se vedea, printre altele, Tomov și altele c. Rusia, nr. 18255/10 și altele 5, §§ 143-56, 9 aprilie 2019), că reclamantul nu a avut nici un remediu de evacuare. În consecință, cele șase luni în ceea ce privește plângerile sale au început să ruleze la 18 decembrie 2017 (data de sfârșit a perioadei reclamate), iar reclamantul ar fi trebuit să-și prezinte plângerile până la 18 iunie 2018. Cu toate acestea, el le-a depus tardiv la 9 ianuarie 2019. Rezultă că aceste plângeri au fost introduse din timp și trebuie respinse în conformitate cu art. 35 §§ § 3 și 4 din Convenție.

Din aceste motive, Curtea declara în unanimitate cererea inadmisibilă. Efectuată în limba engleză și notificată în scris la 15 mai 2025. FACTS AND PROCEDURE

The applicant’s details are set out in the appended table. The applicant’s complaints under Article 3 of the Convention concerning the inadequate conditions of detention during transport and the lack of an effective remedy in that respect were communicated to the Russian Government (“the Government”). THE LAW The applicant complained under Articles 3 and 13 of the Convention of the conditions of detention during transport from 20 January 2016 to 18 December 2017 and the lack of an effective remedy in that respect. The Court notes, regard being had to its well-established case-law on the issue (see, among other authorities, Tomov and Others v. Russia , nos. 18255/10 and 5 others, §§ 143-56, 9 April 2019), that the applicant had no remedy to exhaust.

Accordingly, the six months in respect of his complaints started running on the 18 December 2017 (the end-date of the period complained of), and the applicant should have introduced his complaints no later than 18 June 2018. However, he lodged them belatedly on 9 January 2019. It follows that these complaints were introduced out of time and must be rejected in accordance with Article 35 §§ 3 and 4 of the Convention. For these reasons, the Court, unanimously, Declares the application inadmissible. Done in English and notified in writing on 15 May 2025.
