Gabel împotriva Azerbaidjanului

A cincea secțiune decizia nr. 62437/10 Lidiya Pavlovna GABEL împotriva Azerbaidjanului Curtea Europeană a Drepturilor Omului (A Cincea Secțiune), care a stat la 6 iunie 2019 în calitate de comitet compus din: Yonko Grozev, președinte, Ganna Yudkivska, André Potocki, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 11 octombrie 2010, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTE Reclamantul, dna Lidiya Pavlovna Gabel, s-a născut în 1941. Ea a fost reprezentată în fața Curții de către dl E. Zeynalov, avocat practicant în Azerbaidjan. Plângerile reclamantului în temeiul articolelor 6, 8, 13 și 14 din Convenție, privind refuzul autorităților naționale de a acorda solicitarea reclamantului de a-și modifica dosarele etnice, au fost comunicate guvernului azerbaigian („ Guvernul”).

La 28 februarie 2019, reclamantul a informat Registrul că dorește să retragă cererea la Curte din moment ce a fost rezolvată chestiunea. HOTĂRÂREA Având în vedere cele de mai sus și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea, în conformitate cu articolul (a) din Convenție, consideră că nu mai este justificat să continue examinarea cererii. Prin urmare, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să ia cererea din lista cazurilor sale. FACTS AND PROCEDURE

The applicant, Ms Lidiya Pavlovna Gabel, was born in 1941. She was represented before the Court by Mr E. Zeynalov, a lawyer practising in Azerbaijan. The applicant’s complaints under Articles 6, 8, 13 and 14 of the Convention, concerning the domestic authorities’ refusal to grant the applicant’s request to change her ethnicity records, were communicated to the Azerbaijani Government (“the Government”). On 28 February 2019 the applicant informed the Registry that she wanted to withdraw the application to the Court since the matter had been resolved. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 27 June 2019. Liv Tigerstedt Yonko Grozev Acting Deputy Registrar President
