Isayev împotriva Azerbaidjanului

A cincea secțiune decizia nr. 28440/11 Zaur ISAYEV împotriva Azerbaidjanului Curtea Europeană a Drepturilor Omului (A Cincea Secțiune), care așeză la 21 martie 2019 în calitate de comitet compus din: Síofra O’Leary, președinte, Mārtiδš Mits, Lado Chanturia, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 18 aprilie 2011, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl Zaur Fahrat oglu Isayev, reclamantul, s-a născut în 1980. El a fost reprezentat în fața Curții de către dl J. Hasanov, avocat practicant în Azerbaidjan. Reclamarea reclamantului în temeiul articolului 8 din Convenție privind refuzul autorităților interne de a-l emite un permis de ședere a fost comunicat guvernului azerbaigian („Guvernul”).

La 28 decembrie 2018, reclamantul a informat Registrul că a vrut să retragă cererea la Curte, deoarece această chestiune a fost rezolvată. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE

The applicant, Mr Zaur Fahrat oglu Isayev, was born in 1980. He was represented before the Court by Mr J. Hasanov, a lawyer practising in Azerbaijan. The applicant’s complaint under Article 8 of the Convention concerning the domestic authorities’ refusal to issue him a residence permit was communicated to the Azerbaijani Government (“the Government”). On 28 December 2018 the applicant informed the Registry that he wanted to withdraw the application to the Court since the matter had been resolved. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.
