Aghabayov împotriva Azerbaidjanului

A cincea secțiune DECIZIE Nr. 62357/15 Nazim Mayis oglu AGHABAYOV împotriva Azerbaidjanului Curtea Europeană a Drepturilor Omului (a cincea secțiune), care așeză la 29 august 2019 în calitate de comitet compus din: Yonko Grozev, președinte, Ganna Yudkivska, André Potocki, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 9 decembrie 2015, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl Nazim Aghabayov a fost născut în 1978. Plainele reclamantului în conformitate cu art. 5 § 3 din Convenție privind lungimea excesivă a detenției preventive și în conformitate cu art. 6 § 2 din Convenție privind presunția de innocență au fost comunicate Guvernului Azerbaigian („Guvernul”).

Prin scrisoarea din 29 martie 2019, reclamantul a informat Registrul că a vrut să retragă cererea la Curte, deoarece el nu a fost interesat să își continue cererea. HOTĂRÂREA Având în vedere cele de mai sus, Curtea concluzionează că reclamantul poate fi considerat nu mai dorește să urmărească cererea (articolul (a) din Convenție). În plus, în conformitate cu articolul în amendă , Curtea nu constată nicio circumstanță specială în ceea ce privește respectarea drepturilor omului, astfel cum este definită în Convenția și în Protocolurile sale, care necesită examinarea continuă a cererii. În consecință, cazul ar trebui eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată aplicarea din lista cazurilor sale.

FACTS AND PROCEDURE

The applicant, Mr Nazim Aghabayov, was born in 1978. The applicant’s complaints under Article 5 § 3 of the Convention concerning the excessive length of pre-trial detention and under Article 6 § 2 of the Convention concerning the presumption of innocence were communicated to the Azerbaijani Government (“the Government”). By letter dated 29 March 2019 the applicant informed the Registry that he wanted to withdraw the application to the Court since he was not interested in pursuing his application. THE LAW In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 19 September 2019. Liv Tigerstedt Yonko Grozev Acting Deputy Registrar President
