DECIZIA nr. 7129/15 Dejan SINשELI ȘI alții împotriva Serbiei (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (Secțiunea a treia), care așezează la 29 august 2019 în calitate de comitet compus din: Dmitry Dedov, președinte, Alena Poláčková, Gilberto Felici, judecători și Liv Tigerstedt, secretar adjunct al secțiunii interioare, având în vedere cererea depusă la 18 iulie 2014, Având în vedere observațiile prezentate de Guvernul contestat și observațiile prezentate în răspuns de reclamanții, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIU Lista reclamanților este prezentată în tabelul apendice. Reclamanții au fost reprezentați de dna J. Mihailović, un avocat practicant în Valjevo.
Reclamațiile reclamanților în temeiul articolului 6 § 1 din Convenție privind durata excesivă a procedurilor civile au fost comunicate guvernului sârb („Guvernului”). În prezenta cerere, după examinarea tuturor materialelor dinaintea acesteia, Curtea consideră că, din motivele menționate mai jos, guvernul contestat nu poate fi considerat responsabil pentru durata excesivă a procedurii administrative impugnate. Curtea constată că procesul administrativ a început la 11 septembrie 2006 atunci când reclamanții au depus un recurs la organul competent de a doua instanță (a se vedea Počuča c. Croația) , nr. 38550/02, § 30, 29 iunie 2006). Se pare că procedura este încă în așteptare aproape treisprezece ani mai târziu.
Cu toate acestea, în mod excepțional, perioada care urmează să fie luată în considerare include, de asemenea, procedurile dinaintea Curții Constituționale, deoarece Curtea Constituțională a anulat hotărârile Curții Administrative în cazul reclamanților în două ocazii (la 22 iulie 2010 și 29 În septembrie 2016, aceasta a acționat astfel ca instanță de a patra instanță. În ceea ce privește perioada cuprinsă între 11 septembrie 2006 și 13 martie 2014, Curtea constată că reclamanții nu mai pot pretinde că sunt victime în sensul articolului 34 din Convenție, deoarece, la 13 martie 2014, Curtea Constituțională a recunoscut în mod expres presupusa încălcare și a acordat reclamanților 300 de euro fiecare în ceea ce privește prejudiciile morale.
Cu toate că această sumă este mai mică decât cea atribuită de Curte, Curtea consideră că este încă rezonabil având în vedere circumstanțele specifice ale prezentului caz, în special numărul mare de reclamanți și miza destul de limitată implicată în acest caz. În ceea ce privește perioada după 13 martie 2014, reclamanții nu au epuizat toate căile de recurs interne eficace, astfel cum se prevede la art. 35 § 1 din Convenție, deoarece ar trebui să se plângă din nou la Curtea Constituțională cu privire la întârzierile suplimentare (a se vedea Becová c. Slovacia (dec.), nr. 23788/06, 18 septembrie 2007). Prin urmare, cererea trebuie respinsă în temeiul articolului 35 §§ 1, 3 și 4 din Convenție. Din aceste motive, Curtea, în unanimitate, declară cererea inadmisibilă.

The list of applicants is set out in the appended table. The applicants were represented by Ms J. Mihailović, a lawyer practising in Valjevo. The applicants’ complaints under Article 6 § 1 of the Convention concerning the excessive length of civil proceedings were communicated to the Serbian Government (“the Government”). THE LAW In the present application, having examined all the material before it, the Court considers that for the reasons stated below, the respondent Government cannot be held liable for the excessive length of the impugned administrative proceedings. The Court notes that the administrative proceedings started on 11 September 2006 when the applicants filed an appeal with the competent second-instance body (see Počuča v. Croatia , no. 38550/02, § 30, 29 June 2006). It would appear that the proceedings are still pending almost thirteen years later.
However, exceptionally, the period to be taken into consideration includes also the proceedings before the Constitutional Court since the Constitutional Court quashed the judgments of the Administrative Court in the applicants’ case on two occasions (on 22 July 2010 and 29 September 2016). It thereby acted as a court of fourth instance. As regards the period from 11 September 2006 until 13 March 2014, the Court finds that the applicants can no longer claim to be victims within the meaning of Article 34 of the Convention since, on 13 March 2014, the Constitutional Court expressly acknowledged the alleged breach and awarded the applicants 300 euros each in respect of non-pecuniary damage. Although that amount is lower than those awarded by the Court, the Court considers that it is still reasonable in view of the particular circumstances of this case, notably, the large number of applicants and the rather limited stakes involved in the case.
As to the period after 13 March 2014, the applicants failed to exhaust all effective domestic remedies as required by Article 35 § 1 of the Convention since they should complain again to the Constitutional Court about any further delays (see Becová v. Slovakia (dec.), no. 23788/06, 18 September 2007). The application must therefore be rejected pursuant to Article 35 §§ 1, 3 and 4 of the Convention. For these reasons, the Court, unanimously, Declares the application inadmissible.
