Comunicat la 30 ianuarie 2020 Publicat la 17 februarie 2020 THIRD SECTION Cererea nr. 20069/17 Levon Gareginiovich MANUKYAN împotriva Rusiei și a altor 6 cereri (a se vedea lista adăugată) DECLARAȚII DE FACTE Reclamanții sunt resortisanți ruși. Circumstanțele cazurilor Cauzele, astfel cum sunt prezentate de solicitanți, pot fi rezumate după cum urmează. Reclamanții au fost urmăriți în temeiul Codului de infracțiuni administrative a Federației Ruse. Instanțele au auzit cauzele lor în absența unei părți judecătorești. Reclamanții au fost considerați vinovați ca acuzați și supuși unei penalități. Detaliile referitoare la fiecare cerere apar în apendicele de mai jos. COMPLAINTS Reclamanții se plâng, în temeiul articolului 6 din Convenție, că instanțele care au considerat că cauzele lor nu erau imparțiale.

Dl Novichkov (denumite în continuare: 58589/17 și 75728/17) se plâng în temeiul articolelor 6 1 și 3 litera (c) că nu putea beneficia de asistența juridică gratuită atunci când poliția a instituit proceduri administrative împotriva sa. În ceea ce privește cererile nr. 58589/17 și 75728/17, au existat încălcarea articolului 6 1 și a articolului 3 litera (c) din Convenția (a se vedea Mikhaylova c. Rusia, nr. 46998/08, § 76-102, 19 noiembrie 2015)? În special, interesele justiției impusă acordarea de asistență juridică gratuită reclamantului? Dacă este cazul, reclamantul a oferit ocazia adecvată de a primi asistență juridică înaintea procesului?

STATEMENT OF FACTS

The applicants are Russian nationals. The circumstances of the cases The facts of the cases, as submitted by the applicants, may be summarised as follows. The applicants were prosecuted under the Code of Administrative Offences of the Russian Federation. The courts heard their cases in the absence of a prosecuting party. The applicants were found guilty as charged and subjected to a penalty. The details pertaining to each application appear in the Appendix below. COMPLAINTS The applicants complain under Article 6 of the Convention that the courts which considered their cases were not impartial. Mr Novichkov (applications nos. 58589/17 and 75728/17) complains under Articles 6 §§ 1 and 3 (c) that he could not benefit from free legal assistance when the police instituted administrative proceedings against him .
