CUARTA DECIZIE A SECȚIEI nr. 32184/23 S.M.A. împotriva Țărilor de Jos Curtea Europeană a Drepturilor Omului (a patra secțiune), care a stat la 19 iunie 2025 în calitate de comitet compus din: Anne Louise Bormann , Președintele Sebastian Rădulățu, András Jakab , judecători și Viktoriya Maradodina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 16 august 2023, Având în vedere decizia de a acorda reclamantului anonimat, în conformitate cu art. 47 § 4 din Regulamentul Curții, după ce a deliberat, hotărăște după cum urmează: FACTE ȘI PROCEDIU Reclamantul, S.M.A., este un național Surinamez, născut în 2000, și locuiește în Paramaribo. Reclamantul a fost reprezentat de dna N. Swart, un avocat practicant în Groningen. Denunțul reclamantului în temeiul articolului 8 din Convenție, privind refuzul de a-i acorda reunificarea familială pentru a se alătura mamei sale în Țările de Jos, a fost comunicat guvernului Regatului Țărilor de Jos („Guvernul”). Decontarea în temeiul căreia reclamantul a acceptat ca cererea sa să fie eliminată din lista de cauze a Curții este supusă unei angajamente ale Guvernului de a acorda reclamantului o aprobare provizorie de intrare și un permis de ședere ulterioară în scopul reunificarii familii cu mama sa în Țările de Jos, cu condiția ca reclamantul să îndeplinească cerințele formale în acest sens. La 21 mai 2025, reclamantul a primit o aprobare provizorie de intrare. La sosire, în Țările de Jos, va primi un permis de ședere. DREPTUL Având în vedere cele de mai sus, Curtea consideră că această chestiune a fost rezolvată în sensul articolului 37 § (b) din Convenție și respectul drepturilor omului, astfel cum este definit în Convenție și în protocolele lor, nu solicită ca aceasta să continue examinarea cererii în conformitate cu art. Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, S.M.A., is a Surinamese national, who was born in 2000, and lives in Paramaribo.
The applicant was represented by Ms N. Swart, a lawyer practising in Groningen.
The applicant’s complaint under Article 8 of the Convention, concerning the refusal to grant him family reunification to join his mother in the Netherlands, were communicated to the Government of the Kingdom of the Netherlands (“the Government”).
Subsequently, the parties informed the Court that they had agreed to settle the matter at the domestic level. The settlement under which the applicant agreed to have her application struck out of the Court’s list of cases is subject to an undertaking by the Government to grant the applicant a provisional entry approval and subsequent residence permit for the purpose of family reunification with his mother in the Netherlands, provided that the applicant meets the formal requirements thereto. On 21 May 2025 the applicant was granted a provisional entry approval. Upon arrival, in the Netherlands, he will receive a residence permit.
In view of the above, the Court considers that the matter has been resolved within the meaning of Article
37 §
1
(b) of the Convention and that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the application under Article
37

Accordingly, the application should be struck out of the list.
For these reasons, the Court, unanimously,
Decides
to strike the application out of its list of cases.
