Ei se plâng în fața Curții că nu au primit o indemnizație suplimentară (indenita în mod special) la care se considerau că au dreptul în sensul Legii nr. 210/92. se află în una sau mai multe situații descrise la numerele de 1-5 în hotărârea M.C. și altele c. Italia 5376/11, § 30, 3 septembrie 2013). RĂSPUNSURI LA PĂRȚI CA urmare a adoptării hotărârii pilot M.C.

Italia 5376/11, 3 septembrie 2013), alocările prevăzute de guvern prin legile bugetare pentru plata indemnizațiilor victimelor transfuziilor de sânge infectate și sumele specifice acordate de autoritățile centrale regiunilor au constituit un mecanism eficient de remediere a eșecului structural de la care rezultă constatarea încălcării formulate de Curte (a se vedea Broniowski c. Polonia [GC], nr. 31443/96, § 193, CEDO 2004 V și M.C. și altele, citată anterior, § 117)? Trimiterea se face în special la concluziile Comitetului miniștrilor care au examinat executarea hotărârii în cauză în cadrul celei de-a 1377-a ședințe a lunii iunie 2020 (...) TheItalian authorities adequately settled the problem of the annual adjustment of the IIS at central level.
They earmarked 160 milioane EUR pentru plata taxelor de aeroport datorate pentru serviciile de interes economic general (au their heirs), which were fully paid by 31 decembrie 2014. In respect of current payments, they ensured that the IIS is submitted to annual adjustment based on the inflation rate and paid without delay to the Beneficiaries. These developments were were welcomed by the Committee. To also setle the problem at regional level, the buget law for 2015 earmarked special assessment to the Regions to endable the pay the arrears datorat in respect of the retrospective adjustment of the IIS. These amount of 735 milioane EUR, were to be transferred to the Regions in cuptor annual instalments, between 2015 and 2018. The Committee notad with satisfaction that, thanks to aceste aranjamente, the arrears to be paid by the Regions were to be cleared by the end of 2018 and invitad the authorities to report on the progress in this process.
In respect of current payments, it requested information on the measures adopted to ensure that the Regions submitted the IIS to the required anual adjustment. (...) Având în vedere scopul și obiectul procedurii de hotărâre-pilot, precum și rolul Curții în ceea ce privește art. 46 din convenție (a se vedea Burmich și alții c. Ucraina (radiație) [GC], nr. 46852/13 și al., § 157-161, 181 și 214, 12 octombrie 2017 (extracturi) și trimiterile la acestea), se poate considera că, în cazul de față, litigiul a fost soluționat în sensul articolului 37 alineatul (1) litera (b) din convenție (a se vedea Broniowski c. Polonia (regulament amiabil) [GC], nr. 31443/96, § 35 CEDH 2005 IX și Wolkenberg și altele (dec.), nr. 50003/99, § 34 și 77) S-ar putea concluziona că obiecțiunile ridicate în aceste cereri trebuie soluționate în cadrul măsurilor generale impuse de executarea hotărârii pilot M.C.
și a altor măsuri menționate anterior și că, prin urmare, nu se mai justifică continuarea examinării acestor cereri, în sensul articolului 37 alineatul (1) litera (c) din convenție (a se vedea Burmych , citat anterior, §§ 204 și 208, E.G.c. OBJET DE L’AFFAIRE
Les requérants ou leurs de cujus ont été contaminés par différents virus à la suite de transfusions de sang ou de l’administration de produits dérivés du sang. Ils se plaignent devant la Cour de ne pas avoir reçu une indemnité complémentaire ( indennità integrativa speciale ) à laquelle ils estimaient avoir droit au sens de la loi n o 210/92. Les requérants ou leur de cujus se trouvent dans une ou plusieurs situations décrites aux numéros de 1 à 5 dans l’arrêt M.C. et autres c. Italie (n o 5376/11, § 30, 3 septembre 2013).
QUESTIONS AUX PARTIES
1. À la suite de l’adoption de l’arrêt pilote M.C. et autres c. Italie (n o 5376/11, 3 septembre 2013), les allocations prévues par le Gouvernement à travers les lois budgétaires pour le payement des indemnités aux victimes de transfusions de sang infecté et les montants spécifiques octroyés par les autorités centrales aux Régions, ont-t-elles constitué un mécanisme efficace de nature à remédier à la défaillance structurelle dont découlait le constat de violation formulé par la Cour (voir Broniowski c. Pologne [GC], n o 31443/96, § 193, CEDH 2004 ‑ V et M.C. et autres , précité, § 117)? Référence est faite en particulier aux conclusions du Comité du Ministres ayant examiné l’exécution du jugement en question lors de sa 1377 ème réunion du mois de juin 2020 : « (...) The Italian authorities adequately settled the problem of the annual adjustment of the IIS at central level.

Considérant le but et l’objet de la procédure d’arrêt pilote ainsi que le rôle de la Cour au regard de l’article 46 de la Convention (voir Burmych et autres c. Ukraine (radiation) [GC], n os 46852/13 et al., §§ 157-161, 181 et 214, 12 octobre 2017 (extraits) et les références qui s’y trouvent citées), peut-on considérer que, dans le cas d’espèce, le litige a été résolu au sens de l’article 37 § 1 b) de la Convention (voir Broniowski c. Pologne (règlement amiable) [GC], n o 31443/96, § 35, CEDH 2005 ‑ IX et Wolkenberg et autres (dec.), n o 50003/99, §§ 34 et 77) ? 3. Pourrait-on conclure que les griefs soulevés dans ces requêtes doivent être réglés dans le cadre des mesures générales requises par l’exécution de l’arrêt pilote M.C.
et autres , précité et que, partant il ne se justifie plus de poursuivre l’examen de ces requêtes, au sens de l’article 37 § 1 c) de la Convention (voir Burmych , cité ci-dessus, §§ 204 et 208, E.G. c.
