Comunicat la 20 octombrie 2020 Publicat la 9 noiembrie 2020 CINTIMEA SECȚIUNE Cererea nr. 26568/16 Azer Agagasim oglu GASIMLI împotriva Azerbaidjanului și a altor 14 cereri (a se vedea lista adăugată) Cerințele se referă la presupusul eșec al comisiilor electorale interne și instanțelor de a examina în mod eficient plângerile reclamanților cu privire la diferite nereguli alegeri care se presupunea că au avut loc în cadrul grupurilor cu un singur loc în care au fost candidați în alegerile parlamentare din 1 noiembrie 2015. A existat o încălcare a dreptului reclamanților în temeiul articolului 3 din Protocolul nr. 1 de a participa la alegerile libere care asigură libera exprimare a avizului poporului în alegerea legislației?

Procesul de examinare de către autoritățile interne a plângerilor ofera suficiente garanții împotriva arbitrarității? O astfel de examinare a îndeplinit cerințele prevăzute la art. 3 din Protocolul nr. 1 la Convenție?

SUBJECT MATTER OF THE CASES

The applications concern the alleged failure by the domestic electoral commissions and courts to effectively examine the applicants’ complaints concerning various election irregularities which had allegedly taken place in the single-seat constituencies where they stood as candidates in the parliamentary elections of 1 November 2015.
