A doua secțiune DECIZIE nr. 36244/13 José DE OLIVEIRA COSTA împotriva Portugaliei Curtea Europeană a Drepturilor Omului (a patra secțiune), care a stat la 19 noiembrie 2020 în calitate de comitet al comitetului compus din: Armen Harutyunyan, președinte, Jolien Schukking, Ana Maria Guerra Martins, judecători și Liv Tigerstedt, grefier interimar, având în vedere cererea depusă la 28 mai 2013, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTUL Dl José de Oliveira Costa s-a născut în 1935. El a fost reprezentat de dl Correia Baptista, avocat practicant la Lisabona. Plaga reclamantului în temeiul articolului 4 § 1 din Protocolul nr. 7 la Convenția privind presupusa încălcare a dreptului său de a nu fi pedepsit de două ori pentru aceeași infracțiune a fost comunicată guvernului portughez („ Guvernul”).

După ce a fost notificat că reclamantul a murit la 9 martie 2020, cu o scrisoare din 8 iulie 2020, Registrul a solicitat reprezentantului reclamantului să indique dacă potențiali moștenitori doresc să urmărească cererea în locul reclamantului. La 15 septembrie 2020, reprezentantul reclamantului a informat Registrul că moștenitorii reclamantului nu doreau să continue cu procedura în fața Curții. HOTĂRÂREA Curții ia act de faptul că reclamantul a murit și că moștenitorii săi nu doresc să urmărească cererea în sensul articolului (a) din Convenție. Prin urmare, cazul ar trebui să fie exclus din lista. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE

The applicant, Mr José de Oliveira Costa, was born in 1935. He was represented by Mr Correia Baptista, a lawyer practising in Lisbon. The applicant’s complaint under Article 4 § 1 of Protocol No. 7 to the Convention concerning the alleged violation of his right not to be punished twice for the same offence was communicated to the Portuguese Government (“the Government”). Having been notified that the applicant had died on 9 March 2020, by a letter of 8 July 2020 the Registry asked the applicant’s representative to indicate whether any potential heirs wished to pursue the application in the applicant’s stead. On 15 September 2020 the applicant’s representative informed the Registry that the applicant’s heirs did not wish to continue with the proceedings before the Court.

THE LAW The Court takes note of the fact that the applicant has died and that his heirs do not wish to pursue the application within the meaning of Article 37 § 1 (a) of the Convention. Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
