Cușnir împotriva Republicii Moldova

Publicat la 7 iunie 2021 SECȚIUNE Cerere nr. 1811/18 Valentina CUȘNIR împotriva Republicii Moldova depusă la 22 decembrie 2017 comunicată la 17 mai 2021 OBIECTUL CAUZEI Cererea se referă la presupusele maltraturi ale reclamantului de către poliție în timpul protestelor masive din aprilie 2009. Reclamantul, care a fost deputat al Parlamentului în momentul respectiv, se plânge în temeiul articolului 3 din Convenția autorităților care nu a investigat în mod corespunzător maltraturile de către doi ofițeri de poliție pe care i-a identificat-o (cele două au fost achitate). A existat o încălcare a articolului 3 din Convenție? În special, reclamantul a fost supus maltratului de către poliție și autoritățile au efectuat o anchetă eficientă asupra acuzațiilor sale de maltrat?

SUBJECT MATTER OF THE CASE

The application concerns the applicant’s alleged ill-treatment by the police during the massive protests of April 2009. The applicant, who was a Member of Parliament at the relevant time, complains under Article 3 of the Convention of the authorities’ failure to properly investigate her ill-treatment by two police officers whom she identified (the two were acquitted).

QUESTION TO THE PARTIES

Has there been a violation of Article 3 of the Convention? In particular, was the applicant subjected to ill-treatment by the police and did the authorities carry out an effective investigation into her allegations of ill-treatment? (see Taraburca v. Moldova , no. 18919/10, §§ 38-59, 6 December 2011)
