Banu și alții împotriva României și alte 25 cauze

Rezoluția CM/ResDH(2025)243 Execuția hotărârilor Curții Europene a Drepturilor Omului 26 de cazuri împotriva României (Adoptat de Comitetul de Miniștri la 17 septembrie 2025 la ședința de 1537 a Deputaților Miniștri) Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), având în vedere hotărârile finale transmise de Curte comitetului în aceste cazuri și încălcările articolului 3 din Convenție, stabilite din cauza suprapopulației, a condițiilor materiale și igienice slabe și a deficiențelor în furnizarea asistenței medicale în detenție; Amintind obligația statului contestat, în temeiul articolului 46 alineatul (1) din convenție, de a respecta toate hotărârile finale în cazurile la care a fost parte și că această obligație presupune, peste și peste plata sumelor atribuite de Curte, adoptarea de către autoritățile statului contestat, dacă este necesar: a măsurilor individuale pentru a pune capăt încălcărilor stabilite și a șterge consecințele acestora, astfel încât să atingă, în măsura posibilului, restabilirea în integritate și a măsurilor generale de prevenire a încălcărilor similare;

după ce a invitat Guvernul Statului pârât să informeze Comitetul cu privire la măsurile luate pentru a respecta obligația menționată anterior; După examinarea notelor de informare furnizate de guvern, care indică măsurile individuale adoptate pentru executarea hotărârilor, inclusiv informațiile furnizate cu privire la plata satisfacției juste acordate de Curte (a se vedea documentele DH-DD(2024)855 și DD(2025)852 Având în vedere faptul că problema măsurilor individuale a fost soluționată, având în vedere faptul că reclamanții au încetat să își mai îndeplinească condamnarea la închisoare și că justa satisfacție acordată de Curte a fost plătită; reamintind că problema măsurilor generale necesare în răspunsul la deficiențele constatate de Curte în aceste hotărâri continuă să fie examinată în cadrul Bragadireanu v. România (nr. 22088/04) grup de cauze, de asemenea, având în vedere concluziile Curții în aceste cazuri, și faptul că închiderea acestor cazuri nu prejudecă în niciun caz evaluarea măsurilor generale în ceea ce privește suprapopularea, condițiile materiale și igienice slabe și deficiențe în ceea ce privește prestarea asistenței medicale în detenție; DECLARA că a exercitat funcțiile sale în temeiul articolului 46 alineatul (2) din Convenție în aceste cazuri; CONCLUDE că au fost adoptate măsurile individuale necesare;

DECIDE să continue să supravegheze adoptarea măsurilor generale necesare privind suprapopularea, condițiile materiale și igienice slabe și deficiențe în furnizarea asistenței medicale în detenție în Bragadireanu c. România (nr. 22088/04) grup de cazuri; DECIDE să închidă examinarea acestor cazuri.

Resolution CM/ResDH(2025)243 Execution of the judgments of the European Court of Human Rights Twenty-six cases against Romania (Adopted by the Committee of Ministers on 17 September 2025 at the 1537 th meeting of the Ministers’ Deputies) The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”), Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violations of Article 3 of the Convention established on account of overcrowding, poor material and hygienic conditions and deficiencies in the provision of healthcare in detention; Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required: - of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ; and - of general measures preventing similar violations;

Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation; Having examined the information notes provided by the government indicating the individual measures adopted to execute the judgments including the information provided regarding the payment of the just satisfaction awarded by the Court (see documents DH-DD(2024)855 and DH ‑ DD(2025)852 ); Considering that the question of individual measures was resolved, given that the applicants have ceased serving their prison sentence, and that the just satisfaction awarded by the Court was paid; Recalling that the question of general measures required in response to the shortcomings found by the Court in these judgments continues to be examined within the framework of the Bragadireanu v. Romania (No. 22088/04) group of cases also in the light of the Court’s findings in these cases, and that the closure of these cases therefore in no way prejudges the Committee’s evaluation of the general measures in relation to overcrowding, poor material and hygienic conditions and deficiencies in the provision of healthcare in detention; DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases; CONCLUDES that the necessary individual measures have been adopted;

DECIDES to continue to supervise the adoption of the necessary general measures concerning overcrowding, poor material and hygienic conditions and deficiencies in the provision of healthcare in detention in the Bragadireanu v.
