PRIMEA SECȚIUNE DECIZIE Nr. 46625/14 Grigorios PARIKIDIS și alții împotriva Greciei (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (prima secțiune), care a stat la 6 octombrie 2022 în calitate de comitet compus din: Krzysztof Wojtyczek , președinte, Erik Wennerström Lorraine Schembri Orland , judecători și Viktoriya Maradudina , grefier adjunct al secțiunii interioare , Având în vedere cererea depusă la 23 iunie 2014, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTE Lista reclamanților este prezentată în apendice. Reclamanții au fost reprezentați de doamna E. Ioannidou, un avocat care practică în Saloniki.

1 din Protocolul 1 la Convenție privind dreptul lor de acces la o instanță, precum și modalitățile de compensare pe care le-au primit pentru blocarea terenurilor lor din cauza construcției unei conducte de gaze, au fost comunicate guvernului grec („Guvernul”), care a prezentat observații cu privire la admisibilitatea și meritul. Observațiile au fost transmise reclamanților” reprezentant, care a fost invitat să prezinte observațiile în răspuns. Nu a fost primit niciun răspuns la scrisoarea Registrului. Prin scrisoarea din 14 iunie 2022, trimisă prin intermediul Serviciului de Comunicare Electronic al Curții („eComms”), reprezentantul a fost notificat că perioada permisă de prezentare a observațiilor S-a expirat la 17 mai 2022 și nu s-a solicitat prelungire a timpului.

A fost verificat și a confirmat că reprezentantul a fost conectat la eComms. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmeze cererea. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea hotărăște în unanimitate să pună în aplicare cererea din lista de cazuri.

DECISION Application no. 46625/14 Grigorios PARIKIDIS and Others against Greece (see appended table) The European Court of Human Rights (First Section), sitting on 6 October 2022 as a Committee composed of: Krzysztof Wojtyczek , President, Erik Wennerström , Lorraine Schembri Orland , judges, and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above application lodged on 23 June 2014, Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix. The applicants were represented by Mrs E. Ioannidou, a lawyer practising in Thessaloniki. The applicants’ complaints under Article 6 of the Convention and Article 1 of Protocol 1 to the Convention concerning their right of access to a court, as well as the modalities for the compensation they received for the blocking of their land due to the construction of a gas pipeline, were communicated to the Greek Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicants’ representative, who was invited to submit the observations in response. No reply was received to the Registry’s letter.

By letter dated 14 June 2022, sent via the Court’s Electronic Communication Service (“eComms”), the representative was notified that the period allowed for submission of the observations had expired on 17 May 2022 and that no extension of time had been requested. It was checked and confirmed that the representative had connected to eComms. The representative’s attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. THE LAW In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases.
