Prima secțiune decizia nr. 44320/14 Dimitrios PAPACHRISTOS împotriva Greciei Curții Europene a Drepturilor Omului (prima secțiune), care așezează la 25 august 2022 în calitate de comitet compus din: Krzysztof Wojtyczek , președinte, Erik Wennerström Lorraine Schembri Orland , judecători și Viktoriya Maradodina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 10 iunie 2014, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURA Dl Dimitrios Papachristos, reclamantul, s-a născut în 1933. El a fost reprezentat de dl A. Alexopoulos, avocat practicant în Trikala. Plaga reclamantului în temeiul articolului 6 din Convenție privind refuzul administrației de a respecta o decizie a Curții de Conturi a fost comunicată guvernului grec („Guvernului”), care a prezentat observații cu privire la admisibilitatea și meritul. Observațiile au fost transmise reclamantului, care a fost invitat să-și prezinte propriile observații. Prin scrisoarea din 23 iunie 2021, trimisă de post înregistrat, reclamantul a fost notificat că perioada permisă pentru prezentarea observațiilor sale s-a expirat la 24 martie 2021 și că nu a fost solicitată prelungire a timpului. (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmeze cererea. Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazul ar trebui să fie eliminat din listă. Din aceste motive, Curtea, în unanimitate, decide să scoată cererea din lista sa de cazuri. FACTS AND PROCEDURE

The applicant, Mr Dimitrios Papachristos, was born in 1933. He was represented by Mr A. Alexopoulos, a lawyer practising in Trikala.

The applicant’s complaint under Article 6 of the Convention concerning the refusal of the administration to comply with a decision of the Court of Auditors was communicated to the Greek Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicant, who was invited to submit his own observations. No reply was received to the Registry’s letter.

By letter dated 23 June 2021, sent by registered post, the applicant was notified that the period allowed for submission of his observations

had expired on 24 March 2021 and that no extension of time had been requested. The applicant’s attention was drawn to Article

(a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicant received that letter on 9

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article

(a) of the Convention, considers that it is no longer justified to continue the examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides

to strike the application out of its list of cases.
