Lovestyán și alții împotriva Ungariei

Prima secțiune decizia nr. 43782/21 Modificare LOVESTYÁN împotriva Ungariei și alte 10 cereri (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (prima secțiune), ședința la 17 mai 2023 în calitate de comitet compus din: Alena Poláčková , Președintele Gilberto Felici , Raffaele Sabato , judecători și Attila Teplán, secretar adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere observațiile prezentate de guvernul contestat și observațiile prezentate în răspuns de solicitanți, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDURĂ Lista reclamanților este stabilită în tabelul adăugat. Reclamațiile reclamanților în temeiul articolului 6 § 1 din Convenție privind durata excesivă a procedurii civile au fost comunicate guvernului maghiar („Guvernului”).

Asocierea Dreptului cererilor având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Denumirile în temeiul articolului 6 § 1 din Convenție (lungimea excesivă a procedurii civile) În prezentele cereri, după examinarea tuturor informațiilor de dinaintea acesteia, Curtea consideră că din motivele menționate mai jos, guvernul contestat nu poate fi considerat responsabil pentru prelungirea procedurii. În special, Curtea a constatat că este disponibil în Ungaria un remediu eficace pentru a asigura soluționarea presupuselor plângeri (a se vedea Szaxon c. Ungaria (dec.), nr. 54421/21, 21 martie 2023). Cu toate acestea, reclamanții nu au profitat de această cale juridică.

Având în vedere cele de mai sus, Curtea constată că aceste plângeri sunt inadmisibile pentru neepuizarea recourslor interne și trebuie respinse în conformitate cu art. 35 §§ § 1 și 4 din Convenție. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; declara cererea inadmisibilă.

FACTS AND PROCEDURE

The list of applicants is set out in the appended table. The applicants’ complaints under Article 6 § 1 of the Convention concerning the excessive length of civil proceedings were communicated to the Hungarian Government (“the Government”). THE LAW Joinder of the applications Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. Complaints under Article 6 § 1 of the Convention (excessive length of civil proceedings) In the present applications, having examined all the material before it, the Court considers that for the reasons stated below, the respondent Government cannot be held liable for the protractedness of the proceedings.

In particular, the Court has found that an effective remedy is available in Hungary to provide redress for the alleged grievances (see Szaxon v. Hungary (dec.), no. 54421/21, 21 March 2023). However, the applicants have not availed themselves of this legal avenue. In view of the above, the Court finds that these complaints are inadmissible for non-exhaustion of domestic remedies and must be rejected in accordance with Article 35 §§ 1 and 4 of the Convention. For these reasons, the Court, unanimously, Decides to join the applications; Declares the applications inadmissible.
