A doua secțiune DECIZIE nr. 44466/15 Maryna Yuriyivna KANALYUK împotriva Rusiei și alte 27 de cereri (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (a patra secțiune), care stă la 20 noiembrie 2025 în calitate de comitet compus din: Faris Vehabović , Președintele Lorraine Schembri Orland , Anne Louise Bormann , judecători și Viktoriya Maradudina , grefier adjunct al secțiunii interioare , Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIU Lista reclamanților este prezentată în apendice. Aceste cereri provin din conflictul dintre Ucraina și Federația Rusă după ocuparea și anexarea Crimeei de către Rusia în 2014. Diferite plângeri ale reclamanților în temeiul Convenției au fost comunicate guvernului rus („Guvernului”), care nu și-au prezentat observațiile.

Reclamanții au fost obligați să își prezinte observațiile, împreună cu orice reclamație pentru satisfacție echitabilă (a se vedea detaliile din apendice). În cazul în care reclamanții nu și-au prezentat observațiile, prin scrisorile trimise prin intermediul serviciului de comunicare electronică (eComms) al Curții și/sau prin post înregistrat, acestea au fost notificate că perioada permisă pentru prezentarea observațiilor lor a expirat și că nu au fost solicitate prelungirea termenului (a se vedea tabelul adăugat pentru detalii suplimentare). (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista cazurilor în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmeze cererea.

Cu toate acestea, nu a fost primit niciun răspuns. Având în vedere comportamentul procedural similar al reclamanților, Curtea consideră oportun să le examineze în comun într-o decizie unică. Având în vedere cele de mai sus și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea, în conformitate cu articolul (a) din Convenție, consideră că nu mai este justificat să continue examinarea cererilor. În consecință, cazurile ar trebui să fie excluse din listă. Curtea reiterează că, în conformitate cu art. 37 § 2 din Convenție, poate decide să restabilească o cerere la lista cazurilor, dacă consideră că circumstanțele justifică acest curs.

Din aceste motive, Curtea, în unanimitate, Decide să se alăture cererilor; hotărăște să scoată cererile din lista de cazuri.

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix. These applications originated from the conflict between Ukraine and the Russian Federation after the occupation and annexation of Crimea by Russia in 2014. The applicants’ various complaints under the Convention were communicated to the Russian Government (“the Government”), who did not submit their observations. The applicants were required to submit their observations, together with any claims for just satisfaction (see details in the appendix). When the applicants had failed to submit their observations, by letters sent via the Court’s Electronic Communication Service (eComms) and/or by registered post, they were notified that the period allowed for submission of their observations had expired and that no extension of time had been requested (see appended table for further details).

The applicants’ attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. However, no response has been received. THE LAW Having regard to the similar procedural conduct of the applicants, the Court finds it appropriate to examine them jointly in a single decision. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the applications.

Accordingly, the cases should be struck out of the list. The Court reiterates that under Article 37 § 2 of the Convention it may decide to restore an application to its list of cases if it considers that the circumstances justify such a course. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
