Trebuie remarcat faptul că problema competenței asupra zonei în care se presupune că au avut loc incidentele care au dat naștere plângerilor a fost examinată și hotărâtă de Marele Tribunal în cazul Ucrainei și Olandei împotriva Rusiei ([GC], nr. 80/19/16 și 3 MATTER, §§ 327-66, 9 iulie 2025).
