SECȚIUNEA A DOUA DECIZIE Cerere n 337/03 prezentată de Renata KOUTECKÁ împotriva Republicii Cehe Curtea Europeană a Drepturilor Omului (secțiunea a doua), care are loc la 7 martie 2006 într-o cameră compusă din domnii J.-P. Costa președinte Cabral Barreto Jungwiert Butkevych Ugrekhelidze mei Mularoni, Fura-Sandström, judecătorii domnului S. Naismith, grefier adjunct al secțiunii, Având în vedere cererea menționată anterior formulată la 19 decembrie 2002, având în vedere decizia Curții de a invoca art. 29 alineatul (3) din convenție și de a examina în comun admisibilitatea și fondul cauzei, Având în vedere declarațiile formale de acceptare a unui regulament confidențial al cauzei, După ce a luat act de acest lucru, face următoarea decizie în f un ci o n are a recurentei, Renata Kutecká este cetățean ceh, născut în 1954 și rezident în Praga. Ea este reprezentată în fața Curții de către domnul Choděra, avocat în baroul ceh. Guvernul pârât a fost reprezentat de agentul său, dl V.A. Schorm. Faptele cauzei, așa cum au fost expuse de către părți, pot fi rezumate după cum urmează. La 10 mai 1994, recurenta, în calitate de locator, a intentat o acțiune de modificare a termenului de evacuare a apartamentului său de către chiriaș. Procedura sa se încheie la 18 ianuarie 2005, data la care tribunalul municipal (Městský soud) din Praga a reformat cea de-a patra hotărâre pronunțată în cauza în litigiu de tribunalul din Ecuador (Obvodní soud) din Praga 10. GRIEF Invocând art. 6 alineatul (1) din Convenție, reclamanta se plângea de durata excesivă a procedurii. ÎN DREPT Curtea a primit de la guvern următoarea declarație: Vít Alexander Schorm, Agent of the Government of the Czech Republic, declară că Government of the Czech Republic offer to pay 3 500 EUR to Renata Kutecká with a view to securing a friendly settlement of the above-mented case pandaning before the European Court of Human Rights. Acest sum, which is to cover any pecuniary and moraly damage as well as costs and expenses, will be converted into Czech korunas at the rate applicable on the date of payment, free of any fiscals that may be applicable. It will be plata within tree months from the data of notification of the decizie taken by the Court pursuant to Article 37 § 1 of the European Convention on Human Rights. In the event of failure to pay this sum within the said three-month period, the Government undertake to pay simplu interest on it, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus tree percentage puncts. The payment will constitute the final resolution of the case. Curtea a primit de la reclamantă următoarea declarație: "I, Renata Kutecká, nota that the Government of the Czech Republic are pregred to pay me the sum of 3 500 euro with a view to securing a friendly settlement of the above-mented case pandaning before the European Court of Human Rights. Acest sum, which is to cover any pecuniary and moraly damage as well as costs and expenses, will be converted into Czech korunas at the rate applicable on the date of payment, free of any fiscals that may be applicable. It will be plata within tree months from the data of notification of the decizie taken by the Court pursuant to Article 37 § 1 of the European Convention on Human Rights. From the expiry of the above-mentioned three months until settlement simple interesst shall be plata on the above amount at a rate equal to the marginal lending rate of the European Central Bank during the default period plus tree percentage puncts. I accept the propusal and wave any further claims against the Czech Republic in respect of thefacts giving rise to this application. I declara that this constitutes a final resolution of the case. Les faits de la cause, tels qu’ils ont été exposés par les parties, peuvent se résumer comme suit.
Le 10 mai 1994, la requérante, en qualité de bailleur, intenta une action tendant au changement du délai pour l’évacuation de son appartement par la locataire.
La procédure s’est terminée le 18 janvier 2005, date à laquelle le tribunal municipal
(Městský soud)
de Prague réforma le quatrième jugement rendu en l’affaire par le tribunal d’arrondissement
(Obvodní soud)
de Prague 10.
GRIEF
Invoquant l’article 6 § 1 de la Convention, la requérante se plaignait de la durée déraisonnable de la procédure.
La Cour a reçu du Gouvernement la déclaration suivante
:
“I, Vít Alexander Schorm, Agent of the Government of the Czech Republic, declare that the Government of the Czech Republic offer to pay 3 500 euros to Renata Koutecká with a view to securing a friendly settlement of the above-mentioned case pending before the European Court of Human Rights.
This sum, which is to cover any pecuniary and non-pecuniary damage as well as costs and expenses, will be converted into Czech korunas at the rate applicable on the date of payment, free of any taxes that may be applicable. It will be payable within three months from the date of notification of the decision taken by the Court pursuant to Article 37 § 1 of the European Convention on Human Rights. La Cour a reçu de la partie requérante la déclaration suivante:
“I, Renata Koutecká, note that the Government of the Czech Republic are prepared to pay me the sum of 3 500 euros with a view to securing a friendly settlement of the above-mentioned case pending before the European Court of Human Rights.
This sum, which is to cover any pecuniary and non-pecuniary damage as well as costs and expenses, will be converted into Czech korunas at the rate applicable on the date of payment, free of any taxes that may be applicable. It will be payable within three months from the date of notification of the decision taken by the Court pursuant to Article 37 § 1 of the European Convention on Human Rights. From the expiry of the above-mentioned three months until settlement simple interest shall be payable on the above amount at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. I accept the proposal and waive any further claims against the Czech Republic in respect of the facts giving rise to this application. I declare that this constitutes a final resolution of the case.”
La Cour prend acte du règlement amiable auquel sont parvenues les parties. Elle estime que celui-ci s’inspire du respect des droits de l’homme tels que les reconnaissent la Convention et ses protocoles et n’aperçoit par ailleurs aucun motif d’ordre public justifiant de poursuivre l’examen de la requête (article 37 § 1
in fine
de la Convention).
En conséquence, il convient de mettre fin à l’application de l’article 29
§
3 de la Convention et de rayer l’affaire du rôle.
Par ces motifs, la Cour, à l’unanimité,
