Curtea a acordat reclamantului 126.779.17 roubles.

Prezenta soluție va constitui rezoluția finală a cazului.

The court awarded the applicant 126,779.17 roubles. The judgment was not appealed against and became final. On 8 October 2001 the writ of execution was issued. On 29 November 2001 the applicant submitted the writ of execution of the bailiffs.
On 18 February 2002 he sent the writ of execution to the Ministry of Finance. The judgment was executed on 21 April 2004. COMPLAINTS The applicant complained under Article 1 of Protocol No. 1 about the lengthy non-execution of the judgment in his favour.
THE LAW On 19 October 2006 the Court received the following declaration from the respondent Government signed by their representative Mr P. Laptev: “The authorities of the Russian Federation and the applicant, Mr Mikhail Tyurin, application no. 37078/02, have now reached the following settlement, on the basis of respect for human rights as defined in the European Convention for the Protection of Human Rights and Fundamental Freedoms and Protocols to it, with regard to costs and expenses incurred by the applicant in the course of consideration of the application before the European Court of Human Rights, in order to terminate the proceedings before the European Court of Human Rights on the following terms: (a) Due to humanitarian considerations and interests of respect of human rights, the authorities of the Russian Federation will pay to the applicant the sum of 1,500 euros VAT included, to be converted in Russian roubles on the rate applicable on the date of payment, for legal costs incurred in the proceedings before the European Court of Human Rights.

The above settlement can in no way be interpreted as a recognition on behalf of the authorities of the Russian Federation of violation of any provisions of the Convention and Protocols to it.
The present settlement will constitute the final resolution of the case. [The authorities of the Russian Federation and the applicant further undertake not to request the referral of the case to the Grand Chamber under Article 43 § 1 of the Convention.] Done in English and Russian in two copies each, texts are authentic.” On 25 October 2006 the Court forwarded the above declaration to the applicant. On 11 December 2006 the Court received it signed by the applicant. The Court takes note of the friendly settlement reached between the parties. It is satisfied that the settlement is based on respect for human rights as defined in the Convention and its Protocols and finds no public policy reasons to justify a continued examination of the application (Article 37 § 1 in fine of the Convention).
Accordingly, Article 29 § 3 of the Convention should no longer apply to the case and it should be struck out of the list. For these reasons, the Court unanimously Decides to strike the application out of its list of cases. Søren Nielsen Christos Rozakis Registrar President
