Reclamantul s-a născut în 1957 și trăiește în Gloucestershire. Soția sa a murit în martie 1998, lăsând doi copii născuți în 1984 și 1988. Susținerea sa pentru beneficiile văduvelor a fost făcută la 14 martie 1998 și a fost respinsă la 15 septembrie 1998 pe motiv că nu avea dreptul la beneficiile văduvelor deoarece nu era o femeie. Reclamantul nu a apelat în continuare, deoarece el a considerat sau a fost sfătuit că un astfel de remediu ar fi obligat să eșueze deoarece nu sunt plătite prestații de securitate pentru văduvi în temeiul legislației Regatului Unit.
