Reclamantul s-a născut în 1954 și locuiește în Liverpool. Soția sa a murit la 3 februarie 2001 lăsând copii dependente. Susținerea sa pentru beneficiile văduvelor în cadrul noului sistem a fost făcută la 30 aprilie 2001 și a fost respinsă la 9 mai 2001 din cauza faptului că soția sa a murit înainte de 9 aprilie 2001. Reclamantul a solicitat o reexaminare și la 30 mai 2001 a fost informat că decizia a rămas nemodificată. Această decizie a fost confirmată de un tribunal de apel la 20 octombrie 2001. Reclamantul nu a apelat în continuare, deoarece el a considerat sau a fost sfătuit că un astfel de remediu ar fi obligat să eșueze deoarece nu sunt plătite astfel de prestații de securitate socială văduvilor în temeiul legislației din Marea Britanie.
