Publicat la 17 iunie 2024 SECȚIUNEA TERZĂ Cerere nr. 5769/19 Emmanuel DOULGERAKIS împotriva Greciei depusă la 18 ianuarie 2019 comunicată la 27 mai 2024 OBIECTUL CAUZEI Cererea se referă la prelungirea excesivă a procedurii de custodie între reclamant și fosta sa soție P.P., în special, în noiembrie 2011 P.P. a depus o acțiune împotriva reclamantului care solicită custodia a trei copii și în ianuarie 2013 reclamantul a depus o contraacțiune. Tribunalul de Primă Instanță a emis Hotărârea nr. 272/2016 în iulie 2016. În urma apelurilor de ambele părți, hotărârea nr. 133/2017 a Tribunalului de Apel din Creta de Est a fost eliberată.
Procedura a fost încheiată prin hotărârea nr. 1284/2018 a Curții de Casație publicată în iulie 2018 și finalizată la 3 septembrie 2018, în timp ce a fost posibil ca reclamantul să primească o copie a deciziei începând cu 18 septembrie 2018. 8 din Convenție, având în vedere durata excesivă a procedurii de custodie între reclamant și fosta sa soție P.P. SUBJECT MATTER OF THE CASE
The application concerns the excessive length of custody proceedings between the applicant and his ex-wife P.P. In particular, in November 2011 P.P. lodged an action against the applicant requesting custody of their three children and in January 2013 the applicant lodged a counter-action. The one ‑ member Heraklion Court of First Instance issued decision no. 272/2016 in July 2016. Following appeals by both parties, decision no. 133/2017 of the one-member Eastern Crete Court of Appeal was issued. The proceedings were concluded by decision no. 1284/2018 of the Court of Cassation published in July 2018 and finalised on 3 September 2018, while it was possible for the applicant to receive a copy of the decision from 18 September 2018.
QUESTION TO THE PARTIES
Has there been a violation of the applicant’s right to respect for his family life, contrary to Article 8 of the Convention, having regard to the excessive length of custody proceedings between the applicant and his ex-wife P.P. ( Anagnostakis and Others v. Greece , no. 46075/16, 23 September 2021)?
