D. D. Strupek, avocat practicant în Praga, este reprezentat în fața Curții de către D. D. Strupek, un stat ceh, care a fost născut în 1948 și trăiește în cadrul cazului. Faptele cazului, astfel cum au fost prezentate de reclamant, pot fi rezumate după cum urmează. Contextul procedurii penale În 1998, reclamantul a fost împuternicit de o societate cehă („societatea”) ZV”) să-l reprezinte în procesul privatizării societății S.C. Tepro S.A. (“Tepro”) care are sediul său în Iași. Compania ZV a câștigat oferta organizată de Fondul de Proprietate de Stat („Fondul Proprietatea”) și contractul de transfer de acțiuni a fost încheiat la 21 iulie 1998. Reclamantul nu a câștigat niciun interes economic în Tepro.
Transferul controlului societății către compania ZV a fost puternic opus de sindicatul lucrătorilor numit Sindicatul Liber Tepro („SLT”), condus de dl S („leaderul SLT”) care a contestat validitatea contractului de privatizare la instanță și greve organizate. În iunie 2000, reclamantul a recomandat administratorului ceh al societății ZV serviciile unei societăți („societate P”) pentru serviciile de pază și securitate, conduse de dl C („administratorul societății P”). Termenii contractului dintre cele două societăți au fost discutate la 10 August 2000 la un hotel. Reclamantul a fost prezent la cocktail după conferința de presă; totuși, el a negat că a participat la orice conversație între dl Z („administratorul ZV”), managerul companiei P și B („administratorul Tepro”) în timpul căreia se presupune că a decis să elimine liderul SLT.
Contractul privind furnizarea de servicii de securitate a fost semnat de societatea P și Tepro la 16 august 2000.Atacul împotriva liderului SLT La 19 august 2000 încercarea managerului companiei P și a sa angajații care să preiau posturile de securitate din Tepro au fost împiedicați fizic de SLT. Potrivit reclamantului, în acea zi, managerul companiei P a indicat angajaților săi că liderul SLT ar trebui atacat pentru a-l împiedica să organizeze lucrătorii din SLT împotriva preluării posturilor de securitate de la Tepro. La 20 august 2000, personalul companiei P a reușit să preia posturile de securitate din Tepro. Cu toate acestea, în ziua următoare au fost forțați să iasă. Potrivit autorităților de urmărire, managerul companiei P a dat B, S și V adresa liderului SLT pentru a putea fi atacat.
B l-a invitat pe prietenul său T să participe la atac. La 5 septembrie 2000, el a informat șeful său că el și T au fost de acord să folosească un cuțit în timpul atacului. Managerul companiei P se presupune că a acceptat utilizarea cuțitului declarand că recompensa promisă le va fi dublată dacă liderul SLT a fost ucis. La 7 septembrie 2000, la aproximativ 8 a.m., B și T au atacat liderul SLT în coridorul casei sale și i-a cauzat leziuni fatale. A murit la scurt timp după ce a fost transportat la spital. Investigația Actorii de atac și managerul companiei P au fost arestați la 9 În septembrie 2000 nu au menționat nici o implicare a reclamantului în atac în primele lor declarații. Cu toate acestea, la 11 septembrie 2000, managerul a început să menționeze despre implicarea reclamantului în atac.
Managerul Tepro a fost, de asemenea, arestat la 10 septembrie 2000, dar a început să menționeze despre implicarea reclamantului în discuțiile care au avut loc la hotel la 10 august 2000 numai la 18 septembrie 2000. Dl P, un prieten al managerului companiei P, care se presupune că a fost prezent pentru a compromite conversațiile dintre solicitant și prietenul său, a fost auzit ca martor la 20, 21, 22 și 28 septembrie. El nu a menționat nimic despre implicarea reclamantului în această afacere. Cu toate acestea, atunci când a fost auzit la 10 octombrie 2000, el și-a schimbat poziția, susținând că el a fost prezent la conversația dintre managerul societății P și reclamantul în timpul căreia aceasta din urmă i-a spus celor din urmă că problemele pot fi rezolvate prin eliminarea fizică a liderului SLT.
Potrivit reclamantului, înainte de inițierea procedurii penale împotriva lui, nu a întâlnit nici unul dintre persoanele care au ucis liderul SLT. Majoritatea declarațiilor prezentate în etapa de anchetă privind implicarea reclamantului au fost retrase mai târziu în fața instanțelor din cauză că au fost luate sub presiune ilegală. La 13 septembrie 2000, procurorul a început ancheta împotriva reclamantului și a ordonat poliției să nu-l permită să părăsească țara. În seara din 19 septembrie 2000, reclamantul a fost oprit să traverseze granița românească din Borș. El a fost transportat la Iași de ofițeri de poliție fără o ordine oficială de arestare. Interogația sa a început imediat după sosirea lor la ora 13:30 la 21 septembrie 2000. Interogația a durat până la ora 14:30.
El a implorat să nu fie vinovat și a refuzat nici o implicare în uciderea liderului SLT. La 21 septembrie 2000, procurorul responsabil a organizat o confruntare între reclamantul și managerul companiei P. Avocații reclamantului nu au fost autorizați să pună întrebări celor din urmă. În aceeași zi, reclamantul a fost oficial arestat și plasat în detenție în închisoare. La 26 octombrie 2000, interpretul care a asigurat traducerea conversației care s-a desfășurat în august în hotel a dat o declarație în fața procurorului. El a susținut că reclamantul nu a fost prezent în timpul conversației și că managerii companiilor P, ZV și Tepro au discutat doar termenii contractului care urmează să fie semnați.
La 2 noiembrie 2000, reclamantul a fost auzit în legătură cu o altă acuzație împotriva lui cu privire la infracțiunile de fraudă împotriva patrimoniului public. La 25 noiembrie 2000, procurorul a depus și a inculpat cu Curtea județului Iași reclamantul pentru că a comis infracțiunile de fraudă împotriva patrimoniului public, asocierea cu scopul de a comite o infracțiune și incitarea la omucideri calificate. Împreună cu el au fost inculpați atacatorii liderului SLT și managerii companiilor P și Tepro. Proiectul de inculpare a fost transmis reclamantului numai în limba română. El a reușit să obțină o traducere plătită de el numai după ce prima instanță și-a pronunțat hotărârea. Procesul La ședința din 5 ianuarie 2000 înainte de Curtea județului Iași, managerul Tepro a susținut că procurorul responsabil l-a forțat să scrie declarația dată în cursul fazei de anchetă pe baza unui text deja pregătit.
Prin urmare, el a făcut declarații false. La 9 ianuarie 2000, ziarul “ Monitorul” a publicat o scrisoare de către el în acest sens. Potrivit lui, confruntarea cu reclamantul a fost un teatru pregătit și elaborat de procuror. El a adăugat că a fost de acord să se comporte în mod dictat după ce a fost promis să fie eliberat din detenție și pentru că procurorul l-a amenințat că „oasele sale vor putrezi în închisoare dacă nu-i declară ceea ce i-a fost dictat”. Prin decizia din 23 ianuarie 2001, Curtea Supremă de Justiție a acordat cererile reclamantului, Ambasada Republicii Cehe și a Ministerului Justiției pentru trimiterea cauzei de la Curtea județului Iași către o altă instanță datorită presiunii politice imense care au avut loc la Iași.
Dosarul a fost transferat la Curtea județului Satu Mare. La 5 februarie 2001, tribunalul județului Satu Mare a numit un interpret al limbii cehe care, potrivit reclamantului, nu a fost autorizat pentru această activitate. Prin urmare, el a solicitat numirea același interpret autorizat utilizat de procuror în cursul fazei de anchetă și audierii în fața Curții județului Iași. Cererea sa a fost respinsă din cauza faptului că cheltuielile ar fi prea mari deoarece el a locuit în Iași. La 3 aprilie 2001, alți doi acuzați (T și S) s-au plâns de opresiune folosită împotriva lor de autoritățile investigatoare pentru a face declarații false. În aceeași zi, Curtea a numit un nou interpret din cauza faptului că reclamantul nu a înțeles interpretarea efectuată de cel anterior.
R a împărtășit celula sa în închisoarea București cu reclamantul și cu alte trei co-apăratori. Potrivit declarațiilor sale scrise, el a fost abordat la 21 aprilie 2001 de către un oficial de închisoare și alte patru persoane și a solicitat să semneze o declarație că a auzit reclamantul admitend implicarea sa în crimă și că privatizarea lui Tepro a fost frauduloasă. Pentru serviciile sale i s-a promis mai bine perspectiva de succes a cererii sale de eliberare condiționată. În audierea din 5 iunie 2001, B a refuzat declarația anterioară de incriminare a reclamantului. El a susținut că aceasta a fost dictată de procuror. La 19 iulie 2001, Curtea de Apel Oradea a permis recursul depus de reclamant și de directorul Tepro împotriva hotărârii interlocutorii privind prelungirea detenției lor anterioare.
Acesta a înlocuit detenția lor cu obligația de a nu părăsi reședința lor și a ordonat eliberarea lor. De asemenea, a declarat că faptele descrise în proiectul de pronunțare nu au fost complet confirmate prin declarațiile acuzaților și martorilor auziți în fața instanței. Hotărârea a avut o opinie disidentă în conformitate cu care prelungirea detenției este justificată deoarece motivele pentru luarea măsurii preventive nu s-au schimbat. După ce reclamantul a fost eliberat din detenție, lucrătorii Tepro s-au reunit pe străzile Iași protestând împotriva eliberării. Iulie 2001, Prim-ministrul a participat la una din aceste întâlniri și și-a exprimat sprijinul lucrătorilor. El a numit uciderea liderului SLT o „crimă politică” și a promis să ceară Procurorului General să explice poporului Iași de ce persoanele considerate vinovate de cetățenii Iași au fost urmărite fără a fi reținute.
După două zile, decizia de a elibera reclamantul de la arest a fost contestată de procurorul general care a depus o plângere pentru încălcarea legii la Curtea Supremă de Justiție. De asemenea, a ordonat arestarea reclamantului. La 24 iulie 2001, Tribunalul județului Satu Mare a prelungit detenția reclamantului și a managerului Tepro până la 2 septembrie 2001 luând în considerare cererea Curții Supreme de Justiție de suspendare a deciziei de eliberare a acestora. La 26 septembrie 2001, Curtea Supremă a respins recursul extraordinar depus de Procurorul General și, prin urmare, Curtea județului Satu Mare a înlocuit detenția lor cu obligația de a nu părăsi reședința lor. Potrivit reclamantului, autoritățile de stat au reacționat într-un mod necorespunzător la decizia Curții de Apel de a-l elibera pe el și pe B. Astfel, Ministerul Justiției a efectuat o inspecție la instanță.
Cei doi judecători ai comitetului care au votat în favoarea eliberării reclamantului au fost de facto Un judecător a fost reamintit din poziția președintelui secțiunii criminale a Curții și a fost mutat la secțiune civilă și celălalt judecător a fost mutat la secțiune comercială. Al treilea judecător care a votat împotriva și a redactat un aviz disidentă la decizia rămasă în secțiune penală. La 27 iulie 2001, Ministerul Justiției a depus o cerere la Curtea Supremă de Justiție, cerând o altă trimitere a cauzei la o altă instanță diferită de Curtea Județului Satu Mare. Cererea a fost justificată de acoperirea largă a cauzei și de efectele sale asupra opiniei publice. Ministerul a declarat că cererea de trimitere a dosarului la o altă instanță a fost făcută în cazul insistenței Ambasada Cehă.
Ambasada Cehă a participat la ședința în fața Curții Supreme și a contestat o astfel de măsură. Cererea Ministerului Justiției a fost respinsă. La audierile din 2 iulie 2002 și 3 septembrie 2002 înainte de Curtea județului Satu Mare, deoarece interpretarea în limba cehă nu a fost asigurată, un martor a fost utilizat ca interpret. Prin hotărârea din 5 noiembrie 2011, reclamantul a fost achitat pentru infracțiunea fraudei împotriva patrimoniului public și a fost considerat vinovat de asociere cu scopul de a comite o crimă și de a incita la baterii cu rezultate fatale (instigare la infracțiunea de lovituri cauzatoare de moarte El a fost condamnat la șase ani de închisoare. Curtea a susținut că reclamantul și managerii companiilor P și Tepro au instruit atacatorii să cauzeze numai leziunile liderului SLT care l-ar împiedica de activitățile sale din Tepro timp de câteva săptămâni.
De asemenea, a susținut că atacatorii au depășit instrucțiunile. Cu toate acestea, în afară de acest rezumat foarte general și scurt, instanța nu a indicat cu privire la dovezile specifice pe care le-a invocat pentru a ajunge la concluziile sale. Hotărârea a fost pronunțată reclamantului în română. Procesul de recurs Reclamantul, ceilalți acuzați și biroul procurorului au depus fiecare recurs la Curtea de Apel Oradea. În audierea din 21 august 2003, Curtea a informat reclamantul că următoarea audiere programată la 10 septembrie 2003 va avea loc în absența unui interpret dacă el nu a asigurat unul însuși. Până când nu auziți interpretarea nu a fost asigurată deloc. În reacție la o astfel de instrucție, Ambasada Republicii Cehe a trimis un bilet Supremei Curtea, care a informat ulterior instanța de recurs că interpretarea trebuie asigurată de autoritățile judiciare.
La ședința din 24 septembrie 2003, reclamantul a solicitat instanței să-i permită să audă mai mulți martori în numele său care prezintă o listă cu opt nume în acest sens. Cererea sa a fost respinsă din cauza faptului că audierea noilor martori nu era necesară, fără a furniza alte motive. La sfârșitul audierii avocatului său a prezentat o declarație scrisă finală în care el a subliniat faptul că reclamantul nu avea niciun interes economic în Tepro și, prin urmare, nu a vrut eliminarea liderului SLT. De asemenea, el se plângea de faptul că interpretarea în fața Tribunalului județului Satu Mare a fost asigurată de doi interpreti neautorizați. Prin decizia din 8 octombrie 2003 Curtea de Apel Oradea a anulat parțial hotărârea Tribunalului județului Satu Mare.
Acesta a constatat că reclamantul a fost vinovat de fraudă împotriva patrimoniului public, asocierea cu scopul de a comite o crimă și incitarea la o crimă calificată. El a fost condamnat la 14 ani de închisoare și privarea drepturilor sale civile pentru o perioadă de cinci ani. I s-a ordonat, de asemenea, să plătească o alocație lunară fiicei victimei până la vârsta de 25 de ani, cu condiția ca ea să continue studiile după vârsta deplină. El a fost, de asemenea, ordonat să plătească cheltuielile în legătură cu interpretarea. Appelul depus de solicitant a fost respins. Ca hotărârea primului instanța de judecată, hotărârea instanței de apel nu a furnizat explicații sau considerații privind modificările depunerii de către anumitor martori și acuzați în fața instanței, precum și contradicțiile dintre declarațiile lor.
Reclamantul a interzis un recurs asupra punctelor de drept împotriva hotărârii care invocă că art. 6 § 3 litera (e) din Convenție a fost încălcat, susținând că majoritatea actelor procedurale scrise i-au fost transmise în limba română și că interpretarea înainte de Tribunalul județului Satu Mare a fost asigurată de interpreti neautorizați care nu erau bine înțeleși de el. De asemenea, el se plângea că dreptul său la apărare a fost încălcat din cauza faptului că cererea sa de dovezi suplimentare făcută înaintea instanței de apel a fost respinsă fără motive suficiente. El a subliniat că mărturiile persoanelor prezente la conversația de la hotel erau esențiale pentru a înțelege implicațiile sale în crimă.
O altă plângere a considerat lipsa de imparțialitate a instanțelor interne din cauza unei presiuni politice puternice. Prin decizia pronunțată la 2 iunie 2005, Curtea Înaltă de Casezare și Justiție a anulat parțial decizia Curții de Apel Oradea. Acesta a achitat reclamantul acuzației de fraudă împotriva patrimoniului public, menținând celelalte două acuzații și l-a condamnat la opt ani de închisoare și la cinci ani de privare a drepturilor sale civile. De asemenea, a anulat obligația reclamantului de a plăti pentru cheltuielile legate de interpretare. Din motive medicale, reclamantul a fost autorizat să înceapă condamnarea la 7 septembrie 2005. Totuși, profitând de lipsa de vigilență a autorităților de frontieră pe care a evadat din România în Republica Cehă în iulie 2005. Autoritățile cehe și-au refuzat extrădarea în România.
Reclamantul se plânge în temeiul articolului 6 § 1 din Convenție pentru lipsa de imparțialitate și independență a instanțelor interne. În acest sens, se plânge de intervenția prim-ministrului după eliberarea sa din detenție și mai târziu a Ministerului Justiției care a solicitat renunțare la o altă instanță de jurisdicție de la Curtea de Apel Oradea. El se plânge, de asemenea, de apelul extraordinar depus de Procurorul General împotriva deciziei de a-l elibera de la detenție. El consideră că deciziile instanțelor interne au fost rezultatul fortei presiuni politice exercitate. În temeiul articolului 6 § 3 litera (b) din Convenție, reclamantul se plânge de lipsa presupusă de motivație a deciziilor dictate de instanțe interne.
În baza articolului 6 § 3 litera (d) el susține că Curtea de Apel Oradea a respins propunerea sa pentru dovezi suplimentare fără motive. El susține că instanțele se bazează pe depoziții făcute înainte de acuzația sa care au fost mai târziu retrase în fața instanțelor. Reclamantul se plânge în continuare în temeiul articolului 6 § 3 litera (e) cu privire la încălcarea dreptului său la asistență gratuită a unui interpret pe motiv că interpretii care l-au asistat în fața Tribunalului județului Satu Mare nu au fost certificate de instanță și i-au oferit o interpretare inadecvată, ceea ce i-a creat dificultăți pentru înțelegerea procedurii. El susține, de asemenea, că nu a primit nici un document tradus în limba cehă.
În acest sens, el subliniază că, având în vedere gravitatea acuzației și a sentinței grele confruntate și în ceea ce privește amploarea problemelor de fapt și juridice în cauză, ar fi trebuit să primească cel puțin acuzația și deciziile instanțelor interne traduse în limba cehă într-o formă scrisă. El pretinde, în temeiul articolului 6 § 2 din Convenție, că instanțele române și autoritățile de investigare își îndeplinesc funcțiile cu ideea preconcepută că a comis infracțiunile. El se plânge, de asemenea, de declarațiile făcute de prim-ministru cu privire la presupusa sa vinovăție.
Reclamantul a avut o audiere echitabilă în determinarea acuzației penale împotriva acestuia, în conformitate cu art. 1 și 3 din Convenția ținând seama în special de presupusul refuz al Curții de Apel din Oradea de a auzi martorii propuse în numele reclamantului fără a furniza motive, de presiunile exercitate asupra instanțelor interne de către executiv care ar fi putut afecta imparțialitatea lor și de presupusele dificultăți întâlnite în înțelegerea procedurii? Având în vedere declarațiile Primului Ministru publicate în ziare, a fost dreptul reclamantului la presupunerea de nevinovăție garantată de art. 6 § 2 din Convenția respectată în acest caz?
Application no. 42941/05 Frantisek PŘÍPLATA against Romania lodged on 16 November 2005
The applicant, Mr František Příplata, is a Czech national who was born in 1948 and lives in Uherské Hradiště. He is represented before the Court by Mr D. Strupek, a lawyer practising in Prague. A. The circumstances of the case The facts of the case, as submitted by the applicant, may be summarised as follows.
1.The background of the criminal proceedings In 1998, the applicant was empowered by a Czech company (“company ZV”) to represent it in the process of the privatization of the company S.C. Tepro S.A. (“Tepro”) having its headquarters in Iași. The company ZV won the bid organised by the Fund of State Property (“Fondul Proprietatea”) and the contract for the transfer of shares was concluded on 21 July 1998. The applicant gained no economic interest in Tepro. The transfer of the company’s control to company ZV was strongly opposed by the workers’ trade union called Sindicatul Liber Tepro (“SLT”) lead by Mr S (“the SLT leader”) who challenged the validity of the privatisation contract at the court and organised strikes. In June 2000, the applicant recommended to the Czech manager of company ZV the services of a company (“company P”) for guarding and security services, headed by Mr C (“the manager of company P”). The terms of the contract between the two companies were discussed on 10 August 2000 at a hotel. The applicant was present at the cocktail after the press conference; however, he denied that he had taken any part in the conversation between Mr Z (“the manager of ZV”), the manager of company P and Mr B (“the manager of Tepro”) during which it was allegedly decided to eliminate the SLT leader. The contract on provision of security services was signed by company P and Tepro on 16 August 2000.
2.The attack against the leader of SLT On 19 August 2000 the attempt of the manager of company P and his employees to take over the security posts in Tepro was physically prevented by SLT. According to the applicant, on that day the manager of company P indicated to his employees that the SLT leader should be assaulted in order to prevent him from organising the workers of SLT against the taking over of the security posts at Tepro. On 20 August 2000 the personnel of company P succeeded to take over the security posts in Tepro. However, on the next day they were forced out. According to the prosecuting authorities, the manager of company P gave to B, S and V the address of the SLT leader so that he could be attacked. B invited his friend T to take part in the assault. On 5 September 2000, he allegedly informed his boss that he and T agreed to use a knife during the assault. The manager of company P allegedly consented to the use of the knife stating that the reward promised to them would be doubled if the SLT leader was killed. On 7 September 2000, at about 8 a.m., B and T attacked the SLT leader in the corridor of his house and caused him fatal injuries. He died shortly after being transported to the hospital.
3.The investigation The actors of the assault and the manager of company P were arrested on 9 September 2000. They did not mention any involvement of the applicant in the assault in their first statements. However, on 11 September 2000 the manager started to mention about the applicant’s involvement in the attack. The manager of Tepro was also arrested on 10 September 2000 but he started to mention about the applicant’s involvement in the discussions which took place at the hotel on 10 August 2000 only on 18 September 2000. Mr P, a friend of the manager of company P, who allegedly was present to compromising conversations between the applicant and his friend, was heard as a witness on 20, 21, 22 and 28 September. He did not mention anything about the applicant’s involvement in the affair. However, when he was heard on 10 October 2000 he changed his position alleging that he was present to the conversation between the manager of company P and the applicant during which the latter had allegedly told to the former that the problems could be solved by the physical elimination of the SLT leader. According to the applicant, before the criminal proceedings were initiated against him he had never met any of the persons who killed the SLT leader. Most of the statements given at the investigation stage concerning the applicant’s involvement were retracted later before the courts on the ground that they were taken under illegal pressure. On 13 September 2000 the prosecutor started the investigation also against the applicant and instructed the police not to allow him to leave the country. In the evening of 19 September 2000 the applicant was stopped to cross the Romanian border in Borș. He was transported to Iași by police officers without an official order of arrest. His interrogation started immediately after their arrival at 1.30 a.m. on 21 September 2000. The interrogation lasted until 2.30 p.m. He pleaded not guilty and denied any involvement in the killing of the SLT leader. On 21 September 2000 the prosecutor in charge organised a confrontation between the applicant and the manager of company P. The applicant’s lawyers were not allowed to ask questions to the latter. On the same day the applicant was officially arrested and placed in detention on remand. On 26 October 2000 the interpreter who ensured the translation of the conversation which took place in the hotel in August gave a statement before the prosecutor. He maintained that the applicant was not present during the conversation and that the managers of companies P, ZV and Tepro had only discussed the terms of the contract to be signed. On 2 November 2000 the applicant was heard in connection with another charge against him concerning the offence of fraud against the public patrimony. On 25 November 2000 the prosecutor filed and indicted with the Iași County Court the applicant for having committed the offences of fraud against the public patrimony, association with the purpose to commit an offence and incitement to qualified homicide. Together with him were indicted the attackers of the SLT leader and the managers of the companies P and Tepro. The bill of indictment was delivered to the applicant only in Romanian language. He managed to obtain a translation paid by him only after the first ‑ instance court delivered its judgment.
4.The trial At the hearing held on 5 January 2000 before the Iași County Court, the manager of Tepro alleged that the prosecutor in charge had forced him to write his statement given during the investigation stage on the basis of a text already prepared. Therefore he had made false statements. On 9 January 2000, the newspaper “ Monitorul” published a letter delivered by him in this respect. According to him, the confrontation with the applicant was a theatre prepared and elaborated by the prosecutor. He added that he agreed to behave in the dictated manner after having been promised to be released from detention and because the prosecutor threatened him that “his bones would rot in jail if he did not declare what had been dictated to him”. By a decision of 23 January 2001, the Supreme Court of Justice granted the applications of the applicant, the Embassy of the Czech Republic and of the Ministry of Justice for the referral of the case from the Iași County Court to another court due to the immense political pressure that took place in Iași. The file was transferred to the Satu Mare County Court. On 5 February 2001 the Satu Mare County Court appointed an interpreter of Czech language who according to the applicant was not authorised for this activity. Therefore, he requested the appointment of the same authorised interpreter used by the prosecutor during the investigation stage and the hearings before the Iași County Court. His request was dismissed on the ground that the expenses would be too high since he resided in Iași. On 3 April 2001, two other defendants (T and S) complained about the oppression used against them by the investigating authorities in order to make false statements. On the same day the court appointed a new interpreter due to the fact that the applicant did not understand the interpretation carried out by the previous one. R had shared his cell in Bucharest prison with the applicant and three other co-defendants. According to his written statements he was approached on 21 April 2001 by a prison official and four other persons and requested to sign a statement that he had heard the applicant admitting his involvement in the murder and that the privatisation of Tepro had been fraudulent. For his services he was promised better prospect of success of his application for parole. At the hearing of 5 June 2001, B denied his previous statement incriminating the applicant. He maintained that it was dictated to him by the prosecutor. On 19 July 2001, the Oradea Court of Appeal allowed the appeal lodged by the applicant and the manager of Tepro against the interlocutory judgment on the extension of their pre-trial detention. It replaced their detention with the obligation not to leave their residence and ordered their release. It also stated that the facts as described in the bill of indictment were not completely confirmed by the statements of the defendants and the witnesses heard before the court. The judgment had a dissenting opinion according to which the extension of the detention was justified since the grounds for taking the preventive measure had not changed. After the applicant had been released from detention, workers of Tepro were gathering in the streets of Iași protesting against the release. On 21 July 2001, the Prime Minister at that time, attended one of these meetings and expressed his support to the workers. He called the killing of the SLT leader a “political murder” and promised to ask the General Prosecutor to explain to the people of Iași why the persons considered by the citizens of Iași to be guilty of the murder were prosecuted without being detained. After two days, the decision to release the applicant from arrest was challenged by the General Prosecutor who filed a complaint for breach of law with the Supreme Court of Justice. He also ordered the arrest of the applicant. On 24 July 2001 the Satu Mare County Court extended the detention of the applicant and the manager of Tepro until 2 September 2001 taking into account the request of the Supreme Court of Justice for the suspension of the decision ordering their release. On 26 September 2001 the Supreme Court dismissed the extraordinary appeal lodged by the General Prosecutor and consequently the Satu Mare County Court replaced their detention with the obligation not to leave their residence. According to the applicant, the state authorities reacted in an inappropriate way to the decision of the Oradea Court of Appeal to release him and B from detention. Thus, the Ministry of Justice carried out an inspection at the court. The two judges of the panel who voted in favour of the applicant’s release were de facto sanctioned for the said decision. One judge was recalled from the position of the president of the criminal section of the court and was moved to the civil section and the other judge was moved to the commercial section. The third judge who voted against and drafted a dissenting opinion to the decision remained in the criminal section. On 27 July 2001, the Ministry of Justice lodged a request with the Supreme Court of Justice asking for another referral of the case to another court different from the Satu Mare County Court. The request was justified by the wide media coverage of the case and its effect on the public opinion. The Ministry stated that the request for the referral of the file to another court was made at the insistence of the Czech Embassy. The Czech Embassy attended the hearing before the Supreme Court and contested such a measure. The request of the Ministry of Justice was dismissed. At the hearings of 2 July 2002 and 3 September 2002 before the Satu Mare County Court, as the interpretation in Czech language was not secured, a witness was used as interpreter. By a judgment of 5 November 2011, the applicant was acquitted for the offence of fraud against the public patrimony and found guilty of association with the purpose of committing a crime and of incitement to battery with fatal results ( instigare la infracțiunea de lovituri cauzatoare de moarte ). He was sentenced to six years imprisonment. The court held that the applicant and the managers of the companies P and Tepro had instructed the attackers only to cause to the SLT leader injuries that would prevent him from his activities in Tepro for a few weeks. It also held that the attackers had exceeded the instructions. However, apart from this very general and brief summary the court did not indicate on what specific evidence it relied in order to reach its conclusions. The judgment was delivered to the applicant in Romanian.
5.The appeal proceedings The applicant, the other defendants and the prosecutor’s office each lodged an appeal with the Oradea Court of Appeal. At the hearing of 21 August 2003, the court informed the applicant that the next hearing scheduled on 10 September 2003 would take place in the absence of an interpreter if he did not secure one himself. Until that hearing the interpretation was not secured at all. In reaction to such an instruction the Embassy of the Czech Republic sent a note to the Supreme Court of Justice which subsequently informed the appeal court that the interpretation must be secured by the judicial authorities. At the hearing of 24 September 2003 the applicant asked the court to allow him to hear more witnesses on his behalf submitting a list of eight names in this respect. His request was denied on the ground that the hearing of new witnesses was not necessary, without providing other reasons. At the end of the hearing his lawyer submitted a final written statement in which he stressed that the applicant had no economic interest in Tepro and therefore no reason to want the elimination of the SLT leader. He also complained about the fact that the interpretation before the Satu Mare County Court was ensured by two unauthorised interpreters. By a decision of 8 October 2003 the Oradea Court of Appeal partially quashed the judgment of the Satu Mare County Court. It found the applicant guilty of fraud against the public patrimony, association with the purpose of committing a crime and incitement to a qualified murder. He was sentenced to fourteen years imprisonment and deprivation of his civil rights for a period of five years. He was also ordered to pay a monthly allowance to the daughter of the victim until the age of 25, provided that she continued her studies after reaching full age. He was also ordered to pay the expenses in connection with the interpretation. The appeal lodged by the applicant was dismissed. As the judgment of the first ‑ instance court, the decision of the appellate court did not provide explanations or consideration regarding the changes of the depositions by certain witnesses and defendants before the court, as well as the contradictions between their declarations.
6.The appeal on points of law The applicant lodged an appeal on points of law against the decision invoking that Article 6 § 3 (e) of the Convention had been violated. In this respect he claimed that most of the written procedural acts were delivered to him in Romanian language and that interpretation before the Satu Mare County Court was ensured by non-authorised interpreters who were not well understood by him. He also complained that his right to defence was infringed on account of the fact that his request for further evidence made before the appellate court was dismissed without sufficient reasons. He stressed that the testimonies of the persons present at the conversation held at the hotel were essential for understanding his implication in the murder. Another complaint regarded the lack of impartiality of the domestic courts due to strong political pressure. By a decision delivered on 2 June 2005 the High Court of Cassation and Justice partially quashed the decision of the Oradea Court of Appeal. It acquitted the applicant of the charge of fraud against the public patrimony, maintaining the other two charges and sentenced him to eight years of imprisonment and five years deprivation of his civil rights. It also cancelled the applicant’s obligation to pay for the expenses related to interpretation. For medical reasons the applicant was allowed to start serving his sentence on 7 September 2005. However, taking advantage of the lack of vigilance of the borders authorities he escaped from Romania to the Czech Republic in July 2005. The Czech authorities refused his extradition in Romania. COMPLAINTS 1. The applicant complains under Article 6 § 1 of the Convention about the lack of impartiality and independence of the domestic courts. In this respect he complains about the intervention of the Prime Minister after his release from detention and later of the Ministry of Justice which applied for relinquishment of the jurisdiction from the Oradea Court of Appeal to another court. He also complains about the extraordinary appeal lodged by the General Prosecutor against the decision to release him from detention. He believes that the decisions of the domestic courts were the result of the strong political pressure exercised. 2. Under the Article 6 § 3 (b) of the Convention, the applicant complains about the alleged lack of motivation of the decisions rendered by the domestic courts. 3. Relying on Article 6 § 3 (d) he claims that the Oradea Court of Appeal rejected his proposal for further evidence without any reasons. He maintains that the courts relied on depositions made prior to his accusation which were later retracted before the courts. 4. The applicant further complains under Article 6 § 3 (e) about the infringement of his right to free assistance of an interpreter on the ground that the interprets who assisted him before the Satu Mare County Court were not court-certified and offered him an inadequate interpretation which created to him difficulties in understanding the proceedings. He also alleges that he did not receive any documents translated into Czech language. In this respect he stresses that having regard to the gravity of the charge and the heavy sentence faced and with regard to the extent of the factual and legal issues concerned he should have received at least the indictment and the decisions of the domestic courts translated into the Czech language in a written form. 5. He claims under Article 6 § 2 of the Convention that the Romanian courts and the investigating authorities fulfilled their functions with the preconceived idea that he had committed the offences. He also complains about the declarations made by the Prime Minister about his alleged guilt.

Did the applicant have a fair hearing in the determination of the criminal charge against him, as required by Article 6 §§ 1 and 3 of the Convention taking into account in particular the alleged refusal of the Oradea Court of Appeal to hear the witnesses proposed on behalf of the applicant without providing reasons, the pressure exercised on the domestic courts by the executive which could have affected their impartiality and the alleged difficulties encountered in understanding the proceedings? 2. Having regard to the statements of the Prime Minister published in newspapers, was the applicant’s right to the presumption of innocence guaranteed by Article 6 § 2 of the Convention respected in the present case?
