This Policy informs you, in accordance with Art. 12–13 of Law No. 195/2024 on personal data protection, about the data we process, the purposes and legal bases of the processing, recipients, transfers abroad, retention periods and your rights. Free access without an account does not involve the collection of personal data, except for minimal technical data (the IP address, for security and access-limiting purposes).
2.What data we collect — two distinct categories
| IMPORTANT: Precedentia processes two fundamentally different categories of data: CATEGORY A — Data of platform users (persons searching for case law); CATEGORY B — Personal data contained in the indexed court decisions (the parties to litigation). These two categories have different legal bases, different retention periods and different data subject rights. |
2.1. CATEGORY A — data of platform users
| Data category | Data collected | Legal basis | Purpose |
| Google account | Name, email address, profile photo | Performance of the contract | Authentication and account management |
| Email/password account | Email address, password stored as a hash | Performance of the contract | Authentication, account recovery |
| Search data | Queries entered, filters applied, number of results | Performance of the contract | Displaying the history in your account and configured alerts |
| Saved decisions and alerts | Bookmarked decisions, alert criteria, chosen frequency | Performance of the contract | Account functionality |
| Conversations with the AI Legal Assistant | The text of the case file uploaded or pasted, the questions and answers | Performance of the contract; transfer to Anthropic (USA) — your explicit consent | Generating the response; the text is transmitted to the model processor (Sections 9.1 and 10) |
| Aggregated audience data | Page visited, referrer, browser and device type, country | Legitimate interest | Measuring traffic without cookies and without identifying the visitor |
| Technical data | IP address, user-agent | Legitimate interest | Security, abuse prevention, diagnostics |
| Transaction data | Subscription history, amounts, payment status (no card data) | Performance of the contract and legal obligation | Subscription management, accounting |
| Consents | Date and time, version of the accepted documents, text of the consent, IP address, user-agent | Legal obligation (Art. 7(1) of Law No. 195/2024) | Proof of consent given or withdrawn |
The legal bases correspond to Art. 6(1) of Law No. 195/2024: (a) consent, (b) performance of the contract, (c) legal obligation, (f) legitimate interest. The legitimate interests pursued are the security of the Platform, the prevention of abuse and of automated data extraction, and the aggregated, cookie-free measurement of traffic.
Provision of data: the email address and password (or the Google account) are necessary to conclude the contract — without them the account cannot be created. Payment data are necessary to make a payment. Texts sent to the AI assistant are optional; without them, the only thing you cannot use is the AI assistant. You are under no legal obligation to provide us with data.
| Notice regarding search data: Search queries may contain personal data if the user searches by the name of a party involved in a case (e.g. "Ion Popescu vs. Ministerul Finantelor"). Such data are afforded the same level of protection as any other personal data. |
2.2. CATEGORY B — personal data contained in court decisions
The indexed decisions of the Supreme Court of Justice (CSJ), the Constitutional Court and the ECtHR may, by their nature, contain the following categories of personal data of the parties to litigation:
| Data category | Presence in decisions | Source | Remarks |
| First and last name | Frequent | CSJ, CC, ECtHR | Parties to the litigation, lawyers, witnesses, judges |
| Identification data | Occasional | CSJ, CC | IDNP / personal numeric code may appear in some older decisions |
| Addresses | Occasional | CSJ, CC | Addresses of the parties, of the real estate in dispute |
| Financial data | Frequent | CSJ, CC | Amount of damage, debts, salaries, pensions |
| Medical / health data | Occasional | CSJ, CC, ECtHR | In malpractice, disability and invalidity pension cases |
| Private life data | Occasional | ECtHR, CC | In cases concerning Art. 8 ECHR (private and family life) |
| Criminal data / convictions | Frequent | CSJ (criminal chamber) | Offences, convictions, criminal records |
| Data of minors | Occasional | CSJ, CC | In custody, adoption and child protection cases |
| SCALELAW SOLUTIONS SRL does NOT collect these data from the data subjects. They are contained in public legal acts and are processed in the context of indexing those acts, under the conditions described in Section 4. |
2.3. Minimum age
The Platform is intended for legal professionals and law students and is not directed at children. Under the Terms and Conditions, the minimum age for creating an account is 16. We do not knowingly collect data of children under 14 (Art. 8 of Law No. 195/2024); if we learn that such an account has been created, we close it and delete the data.
2.4. Automated decision-making
We do not take decisions based solely on automated processing, including profiling, which produce legal effects concerning you or similarly significantly affect you. The AI assistant's responses are informative in nature and do not constitute decisions concerning you.
3.Free access without an account — minimal data
Users who access the Platform without creating an account do not provide personal data. In this case, the Platform processes only:
- IP address — for security, abuse prevention and limiting the number of searches per session; the IP address is anonymised for analytics purposes;
- Minimal technical data — browser type, screen resolution — for compatibility purposes;
- Essential technical cookies — for the proper functioning of the Platform (details in the Precedentia Cookie Policy).
These minimal technical data are processed on the basis of the legitimate interest of SCALELAW SOLUTIONS SRL in operating a secure and functional platform. They are not used for profiling anonymous users.
4.Processing of data from court decisions — legal basis and justification
| This is the most sensitive and legally complex section. The indexing and display of court decisions containing personal data of the parties constitutes secondary processing within the meaning of Art. 5(1)(b) and Art. 6(5) of Law No. 195/2024. |
4.1. Applicable legal basis
The processing of personal data contained in the court decisions indexed by Precedentia is based on:
| Primary basis | Public interest — archiving, research and access to case law serve the public interest in the transparency of justice and the rule of law (Art. 6(1)(e) of Law No. 195/2024) |
| Secondary basis | Compatible further processing — the decisions are already public and accessible on the official websites of the courts; Precedentia facilitates access to information that is already public, without creating a new collection of data about individuals |
| Special categories exception | Art. 9(2)(g) of Law No. 195/2024 — processing of special categories of data (medical, criminal) is permitted for reasons of substantial public interest, subject to appropriate safeguards |
| Principle of proportionality | The data are indexed exclusively in the context of public judicial acts — they are not combined with other sources to create profiles of natural persons |
4.2. Publicity of judicial acts — a fundamental principle
The publicity of judicial acts is a fundamental constitutional and procedural principle, recognised in:
- Art. 117 of the Constitution of the Republic of Moldova — court hearings are public;
- The Civil Procedure Code and the Criminal Procedure Code of the Republic of Moldova — court decisions are public acts;
- The Rules of Court of the European Court of Human Rights — ECtHR judgments are public and accessible through the HUDOC database;
- The open justice principle — access to case law is essential for legal certainty and for democratic oversight of the judiciary.
| Precedentia does not make public any data that were not already public. The Platform facilitates searching and accessing decisions that are already publicly available on the official websites of the courts. Indexing them does not cause additional harm to data subjects compared with direct access to the official sources. |
4.3. Safeguards applied — protection of data subjects in decisions
Although the processing is legally justified, SCALELAW SOLUTIONS SRL applies the following additional safeguards to protect the natural persons whose data appear in the indexed decisions:
- We do not combine data from decisions with other data sources (social networks, public registers) to create profiles of natural persons;
- We do not use data from decisions for marketing, commercial profiling or any other purpose incompatible with the purpose of legal research;
- We do not permit the mass extraction of personal data from decisions (scraping) — in accordance with the Acceptable Use Policy;
- Decisions containing sensitive data of minors are displayed according to the anonymisation already applied by the courts upon publication;
- We respond to de-indexing requests in accordance with the procedure in Section 9.
4.4. ECtHR judgments — special regime
Judgments of the European Court of Human Rights are accessed through the official HUDOC API of the Council of Europe, which makes these documents available for public access and redistribution in accordance with its terms of use. ECtHR judgments are partially anonymised by the Court — Precedentia respects the level of anonymisation applied by the source.
5.Purpose of processing — why we process data
| Account management | Creating, authenticating and managing the user's subscription and preferences — basis: performance of the contract |
| Provision of the search service | Processing search queries and displaying relevant results — basis: performance of the contract |
| AI semantic search | Processing natural-language queries for semantic search — basis: performance of the contract |
| AI Legal Assistant | Generating answers to legal questions based on the indexed case law. The case file text and the questions are transmitted to the AI model processor (Anthropic PBC, USA), which does not use them for training — basis: performance of the contract; the transfer to the USA — your explicit consent, requested once before first use |
| Security and anti-abuse | Detecting scraping, unauthorised access and abusive use — basis: legitimate interest |
| Aggregated audience | Understanding how the platform is used in order to improve it, without cookies and without individual profiling — basis: legitimate interest |
| Public-interest archive | Indexing and making accessible the case law of the Republic of Moldova and of the ECtHR — basis: public interest |
| Legal obligations | Retaining data in accordance with mandatory statutory periods — basis: legal obligation |
| Proof of consent | Keeping records of consents given and withdrawn — basis: legal obligation (Art. 7(1)) |
6.Data retention period
| User account and profile data | For the duration of the active account + 30 days after closure (grace period) |
| Search history (with an account) | 12 months, after which it is aggregated and anonymised |
| Conversations with the AI Legal Assistant | Until deleted by the user or until the account is closed; they can be deleted at any time from the interface |
| Aggregated audience data | Maximum 24 months, in aggregated form, without identifying the individual |
| Technical data / security logs | Maximum 12 months |
| Transaction data / invoices | In accordance with the mandatory statutory periods of the Republic of Moldova (at least 5 years) |
| Indexed court decisions | For the duration of the Platform's operation or until de-indexed upon a justified request (Section 9) |
| Consent records | For the duration of the account and for 3 more years after its closure (the general limitation period), in order to be able to demonstrate consent |
| Data following an erasure request (user account) | Deleted within a maximum of 30 days, except for data subject to mandatory statutory retention |
Indexed court decisions are not "user data" and are not subject to erasure at the user's request. The procedure for de-indexing decisions at the request of the data subjects named in those decisions is described in Section 9.
7.Rights of platform users (category A)
Users who hold a Precedentia account or who have provided personal data enjoy:
- The right of access — a copy of the data processed about you;
- The right to rectification — correction of inaccurate data;
- The right to erasure — deletion of the account and associated data;
- The right to restriction of processing — under the conditions provided by law;
- The right to data portability — your data in a structured format;
- The right to object — to processing based on legitimate interest;
- Withdrawal of consent — at any time, as easily as you gave it: consent for the AI assistant is withdrawn with one click from Profile › Privacy; consent given when creating the account is withdrawn by requesting closure of the account. Withdrawal does not affect the lawfulness of processing carried out before the withdrawal;
- The right not to be subject to a decision based solely on automated processing;
- The right to lodge a complaint with the National Center for Personal Data Protection (CNPDCP) (Section 14).
| How to exercise your rights as a user: Email: info@applexium.com (recommended subject: "DATE PERSONALE PRECEDENTIA — [tipul solicitarii]") Response time: maximum 30 calendar days. |
8.Rights of persons whose data appear in decisions (category B)
| This section is addressed to natural persons whose personal data appear in the indexed court decisions — not to platform users. If your name, address, medical data or other personal data appear in a court decision indexed by Precedentia, you have the specific rights described below. |
8.1. Limits of the right to erasure for data in decisions
The right to erasure (the right to be forgotten) does not apply automatically to data in court decisions, for the following legal reasons:
- Court decisions are public acts issued in the exercise of public authority — erasing them would contravene the principle of publicity of judicial acts and could constitute an impermissible interference with the administration of justice;
- Case law has normative value — judicial precedents are essential for legal certainty and cannot be suppressed at an individual's request;
- The data are processed for a public-interest purpose — an exception to the right to erasure recognised by the GDPR and Law No. 195/2024.
8.2. The right to de-indexing — when it applies
Although erasure is not possible as a general rule, SCALELAW SOLUTIONS SRL examines de-indexing requests on a case-by-case basis. De-indexing may be granted in exceptional situations, including where:
- The decision contains data of an identifiable minor, published without the anonymisation required by law;
- The decision contains medical data or other sensitive data whose publication was not necessary and whose continued display causes harm disproportionate to the public interest;
- The decision was published in error or contains personal data included through judicial error;
- The court that issued the decision has subsequently ordered the anonymisation or withdrawal of the document from public circulation.
| De-indexing from Precedentia is not equivalent to deleting the decision from the court's official website. If you wish a judicial act to be deleted or anonymised, you must apply directly to the court that issued it. Precedentia is a search engine — it has no control over the source documents. |
8.3. Procedure for requesting de-indexing
| Contact channel | Email: info@applexium.com (subject: "DEZINDEXARE HOTĂRÂRE PRECEDENTIA") |
| Required information | The URL or identifier of the decision in Precedentia; the personal data concerned; the reason for the request; supporting documents (if any) |
| Review period | Maximum 30 calendar days from receipt of the complete request |
| Decision | Granted / Rejected with reasons. A rejection may be challenged before the National Center for Personal Data Protection (CNPDCP). |
| Effect of de-indexing | The decision no longer appears in Precedentia search results, but remains on the court's official website |
8.4. The right to object for data in decisions
Data subjects may object to the processing of their data contained in decisions on grounds relating to their particular situation. SCALELAW SOLUTIONS SRL will examine the objection taking into account:
- The nature of the data involved (ordinary vs. special categories);
- The specific harm invoked as against the public interest in access to case law;
- The existence of alternative technical measures (e.g. exclusion from indexing without deletion from the source).
9.Sharing data with third parties
SCALELAW SOLUTIONS SRL does not sell or rent user data. Data may be shared with third parties only in the following situations:
9.1. Technical service providers
| Recipient | What it receives | Where it is established |
| Google Ireland Ltd. / Google LLC | Only for users who choose “Sign in with Google”: name, email address and profile photo, for authentication — policies.google.com/privacy | Ireland / USA |
| BC „Maib” S.A. | When a payment is initiated: name, email address, amount, order identifier and IP address. Card data are entered directly on the bank's page and do not pass through the Platform | Republic of Moldova |
| Anthropic PBC | The case file text, the questions and the context of the conversation with the AI Legal Assistant (which may contain personal data, including about third parties), for generating the response — only after your explicit consent. Under the provider's commercial terms, data transmitted via the API are not used to train models | USA |
| Umami Software, Inc. | Aggregated traffic measurement: page visited, referrer, browser and device type, country. The service does not set cookies and does not store the IP address | USA |
| Hostinger International Ltd. | Hosting of the server and database, as well as the transactional email service (smtp.hostinger.com). The server is located in Vilnius, Lithuania (EU) | Lithuania (EU) |
| HUDOC (Council of Europe) | Receives no data about users — it is the source from which we obtain ECtHR judgments | France |
9.2. Exceptional situations
- Legal obligations — at the request of the competent authorities, in accordance with the law;
- Defence of the legal rights of SCALELAW SOLUTIONS SRL;
- Corporate reorganisation — users are notified in advance.
10.International data transfers
The Platform's server and database are located in Vilnius, Lithuania (European Union). Some recipients are established outside the Republic of Moldova. Transfers take place as follows:
- Anthropic PBC (USA) — texts sent to the AI assistant, which may contain personal data. The transfer takes place on the basis of your explicit consent (Art. 49(1)(a) of Law No. 195/2024), requested through a separate checkbox before the first use of the assistant, and for the performance of the contract (Art. 49(1)(b)). Risks: the USA may not ensure a level of data protection equivalent to that of the Republic of Moldova, and US authorities may have access to the data under their legislation. You can use the rest of the Platform without the AI assistant;
- Google Ireland Ltd. / Google LLC (EU / USA) — only if you choose to sign in with Google, at your request (Art. 49(1)(b));
- Umami Software, Inc. (USA) — technical traffic data, without cookies and without storing the IP address, on the basis of the provider's contractual safeguards;
- Hostinger International Ltd. (Lithuania, EU) — server hosting and transactional email;
- All providers that receive personal data process them as processors, on the basis of data processing agreements. A copy of the applicable safeguards may be requested at info@applexium.com.
Users in the European Union enjoy all GDPR rights, to the extent that the processing falls within its scope.
11.Data security
- Transmission of data over encrypted connections (HTTPS / TLS);
- Passwords stored using bcrypt / Argon2 algorithms;
- Access to data restricted exclusively to authorised personnel;
- Traffic monitoring to detect unauthorised access and scraping;
- Anonymisation of IP addresses for analytics purposes.
In the event of a security incident affecting user data, we will notify the National Center for Personal Data Protection (CNPDCP) within 72 hours and the affected users as soon as possible.
12.Cookies and similar technologies

13.Changes to the Privacy Policy
We reserve the right to update this Policy to reflect legislative, technical or operational changes. Significant changes will be communicated by email and/or by a prominent notice on the Platform at least 14 days before they take effect.
