Winkel împotriva Poloniei

Publicat la 21 octombrie 2024 PRIMEA SECȚIUNE Cerere nr. 9397/23 Marcin WINKEL împotriva Poloniei depusă la 13 februarie 2023 a comunicat la 30 septembrie 2024 OBIECTUL CAUZEI Cererea se referă la impunerea regimului „deținut periculos” în ceea ce privește reclamantul de la 13 septembrie 2022 până la 7 iunie 2023. Reclamantul se plâng în temeiul articolului 3 din Convenție că această perioadă de nouă luni a constituit tratament inuman și degradant. Având în vedere efectul cumulativ al regimului „deținut periculos”, impus reclamantului de la 13 septembrie 2022 până la 7 iunie 2023, a fost supus unui tratament contrar articolului 3 din Convenție (a se vedea Piechowicz c. Polonia , nr. 20071/07, 17 aprilie 2012)?

SUBJECT MATTER OF THE CASE

The application concerns the imposition of the “dangerous detainee” regime with regard to the applicant from 13 September 2022 until 7 June 2023. The applicant complains under Article 3 of the Convention that this period of nine months amounted to inhuman and degrading treatment.

QUESTION TO THE PARTIES

Having regard to the cumulative effect of the “dangerous detainee” regime, imposed on the applicant from 13 September 2022 until 7 June 2023, has he been subjected to treatment contrary to Article 3 of the Convention (see, Piechowicz v. Poland , no. 20071/07, 17 April 2012)?
