Ludwisiak și alții împotriva Poloniei

Prima secțiune decizia nr. 54461/21 Agnieszka LUDWISIAK împotriva Poloniei și a altor 10 cereri (a se vedea tabelul anexat) Curtea Europeană a Drepturilor Omului (prima secțiune), ședința la 3 octombrie 2024 în calitate de comitet compus din: LÄtif Hüseynov , Președintele Krzysztof Wojtyczek, Erik Wennerström , judecători și Viktoriya Maradudina , grefier adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul anexat, având în vedere decizia de a acorda reclamantului în cererea nr. 12687/22 anonimitate, în conformitate cu art. 47 § 4 din Regulamentul Curții, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIU Lista reclamanților și a reprezentanților acestora este prezentată în apendice.

Reclamațiile reclamanților în temeiul articolului 6 § 1 din Convenție privind o încălcare a dreptului lor la o audiere de către un „cort independent și imparțial instituit prin lege”, deoarece cazurile lor civile sau penale au fost hotărâte de grupuri de judecători ale Curții Supreme, compuse de judecători desemnați în procedura care implică Consiliul Național al Judiciilor, au fost comunicate guvernului polonez (“Guvernul”), care au prezentat observații cu privire la admisibilitatea și meritele. Observațiile au fost transmise reclamanților, care au fost invitați să își prezinte propriile observații (a se vedea tabelul anexat pentru datele relevante). Nu s-a primit răspuns la scrisorile Registrului.

La diferite date indicate în tabel, reclamanții au fost notificați că perioada autorizată pentru prezentarea observațiilor S-a expirat și nu s-a solicitat nici o prelungire a timpului.Atenția reclamanților a fost atrasă la articolul (a) din Convenție, care prevede că Curtea poate elimina o cerere din lista sa de cauze în cazul în care circumstanțele conduc la concluzia că reclamantul nu intenționează să urmărească cererea. Avocații reclamanților au primit aceste scrisori prin postul înregistrat sau prin intermediul sistemului de comunicare electronică al Curții (eComms), la diferite date indicate în tabel. Cu toate acestea, nu a urmat niciun răspuns. HOTĂRÂREA având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie.

Având în vedere cele de mai sus, și în absența unor circumstanțe speciale privind respectarea drepturilor garantate de Convenția și de protocolele sale, Curtea consideră, în conformitate cu articolul (a) din Convenție, că nu mai este justificat continuarea examinării cererii. În consecință, cazurile ar trebui să fie excluse din listă. Din aceste motive, Curtea, în unanimitate, decide să se alăture cererilor; hotărăște să scoată cererile din lista de cazuri.

DECISION Application no. 54461/21 Agnieszka LUDWISIAK against Poland and 10 other applications (see appended table) The European Court of Human Rights (First Section), sitting on 3 October 2024 as a Committee composed of: Lətif Hüseynov , President , Krzysztof Wojtyczek, Erik Wennerström , judges , and Viktoriya Maradudina, Acting Deputy Section Registrar, Having regard to the above applications lodged on the various dates indicated in the appended table, Having regard to the decision to grant the applicant in application no. 12687/22 anonymity, in accordance with Rule 47 § 4 of the Rules of the Court, Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants and their representatives is set out in the appendix. The applicants’ complaints under Article 6 § 1 of the Convention about a violation of their right to a hearing by an “independent and impartial tribunal established by law,” since their civil or criminal cases had been decided by panels of the Supreme Court composed of judges appointed in the procedure involving the National Council of the Judiciary, were communicated to the Polish Government (“the Government”), who submitted observations on the admissibility and merits. The observations were forwarded to the applicants, who were invited to submit their own observations (see the appended table for the relevant dates).

No reply was received to the Registry’s letters. On various dates indicated in the table the applicants were notified that the period allowed for submission of the observations had expired and that no extension of time had been requested. The applicants’ attention was drawn to Article 37 § 1 (a) of the Convention, which provides that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. The applicants’ lawyers received these letters by registered post, or via the Court’s Electronic Communication System (eComms), on various dates indicated in the table. However, no response has followed.

THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision. In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention and the Protocols thereto, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application. Accordingly, the cases should be struck out of the list. For these reasons, the Court, unanimously, Decides to join the applications; Decides to strike the applications out of its list of cases.
