CUARTA DECIZIE DECIZIE Nr. 27782/06 Iulia DUMITRESCU împotriva României Curtea Europeană a Drepturilor Omului (A patra secțiune), care a stat la 17 octombrie 2024 în calitate de comitet compus din: Anne Louise Bormann , Președintele Sebastian Rădulețu, Mateja δurović , judecători și Viktoriya Maradudina, grefierul adjunct al secțiunii interioare, având în vedere cererea depusă la 23 iulie 2002, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTE Detaliile reclamantului sunt prezentate în tabelul adăugat. Plegina reclamantului în temeiul art. 1 din Protocolul nr. 1 la Convenția privind cererile sale de proprietate situate în București a fost comunicată Guvernului României (“Guvernul”).

După aceea, Guvernul a informat Curtea că Comisia Națională pentru Compensarea Proprietăților (Comisia Națională pentru Compensarea Imobilelor – denumită în continuare „CNPC”) a emis la 10 noiembrie 2008 o decizie de compensare în ceea ce privește proprietatea reclamată, pentru valoarea de 430.018 lei români (RON). Această decizie nu a fost contestată. La 23 noiembrie 2020, dl Gabriel Dumitrescu, moștenitorul reclamantului, a prezentat o cerere de eliberare a titlurilor de plată pentru sumele datorate. Începând cu decembrie 2020, NCPC a emis cinci titluri de plată anuale, ultima data de 8 aprilie 2024. La 31 iulie 2024, Guvernul a susținut că toate titlurile de plată au fost executate, suma totală fiind acum încasată de moștenitorul reclamantului.

Acestea din urmă nu au prezentat niciun comentariu sau alte informații referitoare la cele mai recente observații ale guvernului. HOTĂRÂREA Având în vedere cele de mai sus, Curtea consideră că această chestiune a fost rezolvată în sensul articolului 37 § (b) din Convenție și respectul drepturilor omului, astfel cum este definit în Convenție și în protocolele lor, nu solicită ca aceasta să continue examinarea cererii în conformitate cu art. FACTS AND PROCEDURE

The applicant’s details are set out in the appended table. The applicant’s complaint under Article 1 of Protocol No. 1 to the Convention concerning her claims to property located in Bucharest was communicated to the Romanian Government (“the Government”). Subsequently, the Government informed the Court that the National Commission for Property Compensation ( Comisia Naționalǎ pentru Compensarea Imobilelor – hereinafter “the NCPC”) had issued on 10 November 2008 a compensation decision in respect of the claimed property, for the amount of 430,018 Romanian lei (RON). That decision was not challenged. On 23 November 2020 Mr Gabriel Dumitrescu, the applicant’s heir, submitted a request for the issuance of payment titles for the amounts due.

As of December 2020, the NCPC had issued five yearly payment titles, the last one dated 8 April 2024. On 31 July 2024 the Government submitted that all the payment titles had been executed, the full amount being currently cashed in by the applicant’s heir. The latter has not submitted any comments or other information relating to the Government’s latest submissions. THE LAW In view of the above, the Court considers that the matter has been resolved within the meaning of Article 37 § 1 (b) of the Convention and that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the application under Article 37 § 1 in fine . Accordingly, the application should be struck out of the list.

For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 14 November 2024.
