FIFTH SECTION
DECISION Application no. 16715/14 Igor KOVAČ against Slovenia The European Court of Human Rights (Fifth Section), sitting on 24 March 2015 as a Committee composed of: Helena Jäderblom, President, Boštjan M. Zupančič, Aleš Pejchal, judges, and Milan Blaško, Deputy Section Registrar, Having regard to the above application lodged on 19 February 2014, Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Igor Kovač, is a Slovenian national, who was born in 1956. He was represented before the Court by Mr Matiček Žumer, a lawyer practising in Ljubljana. The Slovenian Government (“the Government”) were represented by their Agent, Ms Nataša Pintar Gosenca. The applicant complained under Article 3 of the Convention about the material conditions of detention in the remand section of Ljubljana Prison, and under Article 13 of the Convention about the lack of an effective domestic remedy in that regard. After the Government had been given notice of the application, the applicant informed the Court that he wished to withdraw his application introduced before the Court. THE LAW In view of the foregoing the Court is satisfied that the applicant does not intend to pursue his application within the meaning of Article 37 § 1 (a) of the Convention.
Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case. In view of the above, it is appropriate to strike the application out of the list. For these reasons, the Court, unanimously, Decides to strike the application out of its list of cases. Done in English and notified in writing on 16 April 2015. Milan Blaško Helena Jäderblom Deputy Registrar President
