Martins Castro și Alves Correia de Castro și alte 28 cauze împotriva Portugaliei

Rezoluția CM/ResDH(2016)99 Execuția hotărârilor Curții Europene a Drepturilor Omului 29 de cazuri împotriva Portugaliei (A se vedea apendicele pentru lista de cazuri) (Adoptat de Comitetul de Miniștri la 4 mai 2016 la ședința 1255 a Deputaților Miniștrilor) Comitetul de miniștri, în conformitate cu art. 46 alineatul (2) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea hotărârilor finale ale Curții Europene a Drepturilor Omului (denumită în continuare „Convenția” și „Curtea”), având în vedere hotărârile finale transmise de Curte comitetului în aceste cazuri și încălcarea stabilită care vizează lipsa eficacității unui remediu compensatoriu disponibil victimelor de proceduri excesiv de lungi (violații la art. 6 alineatul (1) și la art. 13); Amintind obligația statului contestat, în temeiul articolului 46 alineatul (1) din convenție, de a respecta toate hotărârile finale în cazurile la care a fost parte și că această obligație presupune, peste și peste plata sumelor atribuite de Curte, adoptarea de către autoritățile statului contestat, dacă este necesar: a măsurilor individuale pentru a pune capăt încălcărilor stabilite și a șterge consecințele acestora, astfel încât să atingă, în măsura posibilului, restabilirea în integritate și a măsurilor generale de prevenire a încălcărilor similare;

după ce a invitat Guvernul Statului pârât să informeze Comitetul cu privire la măsurile luate pentru a respecta obligația menționată anterior; După examinarea raportului de acțiune furnizat de guvern în care se indică măsurile adoptate pentru a da efect hotărârilor, inclusiv informațiile furnizate cu privire la plata satisfacției echitabile acordate de Curte (a se vedea documentul DH-DD(2016)397 Amintind, de asemenea, că Comitetul continuă să examineze problema lungii excesive a procedurilor judiciare în cadrul grupului Oliveira Modesto și altor grupuri; având în vedere că toate măsurile prevăzute la art. 46 alineatul (1) au fost adoptate, DECLAREA că și-a exercitat funcțiile în temeiul articolului 46 alineatul (2) din convenție în aceste cazuri și DECIDE să încheie examinarea acestuia.

Resolution CM/ResDH(2016)99 Execution of the judgments of the European Court of Human Rights 29 cases against Portugal (See Appendix for the list of cases) (Adopted by the Committee of Ministers on 4 May 2016 at the 1255 meeting of the Ministers’ Deputies) The Committee of Ministers, under the terms of Article 46, paragraph 2, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of final judgments of the European Court of Human Rights (hereinafter “the Convention” and “the Court”), Having regard to the final judgments transmitted by the Court to the Committee in these cases and to the violation established which concerns the lack of effectiveness of a compensatory remedy available to victims of excessively lengthy proceedings (violations of Article 6, paragraph 1, and of of Article 13); Recalling the respondent State’s obligation, under Article 46, paragraph 1, of the Convention, to abide by all final judgments in cases to which it has been a party and that this obligation entails, over and above the payment of any sums awarded by the Court, the adoption by the authorities of the respondent State, where required: - of individual measures to put an end to violations established and erase their consequences so as to achieve as far as possible restitutio in integrum ;

and - of general measures preventing similar violations; Having invited the government of the respondent State to inform the Committee of the measures taken to comply with the above-mentioned obligation; Having examined the action report provided by the government indicating the measures adopted in order to give effect to the judgments including the information provided regarding the payment of the just satisfaction awarded by the Court (see document DH-DD(2016)397 ); Recalling also that the Committee continues to examine the issue of the excessive length of judicial proceedings within the framework of the Oliveira Modesto and others group; Having satisfied itself that all the measures required by Article 46, paragraph 1, have been adopted, DECLARES that it has exercised its functions under Article 46, paragraph 2, of the Convention in these cases and DECIDES to close the examination thereof.
