Publicat la 26 ianuarie 2026 PRIMEA SECȚIUNE Cerere nr. 30729/24 Dragica SUNEK împotriva Croației depusă la 17 octombrie 2024 a comunicat la 9 ianuarie 2026 OBIECTUL CAUZEI Cererea se referă la decizia Curții Constituționale de a atribui reclamantului compensații pentru durata excesivă a procedurii, dar de a refuza să-i acorde costurile reprezentației sale juridice, care au depășit suma compensației. Reclamantul se plâng în temeiul articolului 6 § 1 din Convenție că refuzul Curții Constituționale de a-i atribui costurile reprezentației sale juridice a avut un efect disuasiv asupra exercitării dreptului de acces la această instanță. A fost refuzul Curții Constituționale de a atribui reclamantului costurile reprezentației sale juridice în fața instanței în încălcarea dreptului ei de acces la o instanță în temeiul articolului 6 § 1 din Convenție (a se vedea Moskalj c. Croația, nr. 60272/21, §§ 79-94, 15 octombrie 2024)?

SUBJECT MATTER OF THE CASE

The application concerns the Constitutional Court’s decision to award the applicant compensation for the excessive length of proceedings but to refuse to grant her the costs of her legal representation, which exceeded the amount of the compensation. The applicant complains under Article 6 § 1 of the Convention that the Constitutional Court’s refusal to award her the costs of her legal representation had a deterrent effect on the exercise of her right of access to that court.

QUESTION TO THE PARTIES

Was the Constitutional Court’s refusal to award the applicant the costs of her legal representation before that court in breach of her right of access to a court under Article 6 § 1 of the Convention (see Moskalj v. Croatia , no. 60272/21, §§ 79-94, 15 October 2024)?
