CUARTA DECIZIE DECIZIE Nr. 58137/15 Vasile RUS împotriva României Curtea Europeană a Drepturilor Omului (Quarta Secțiunea), care așezează la 27 aprilie 2017 în calitate de comitet compus din: Vincent A. De Gaetano, președinte, Egidijus Kūris, Gabriele Kucsko-Stadlmayer, judecători și Karen Reid, grefierul secțiunii, având în vedere cererea depusă mai sus la data indicată în tabelul anexat, După deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIMENTE Detaliile relevante ale cererii sunt prezentate în tabelul adăugat. Plainele reclamantului în temeiul articolului 3 din Convenție privind condițiile inadecvate de detenție au fost comunicate guvernului român („Guvernul”). În prezenta cerere, după examinarea tuturor materialelor dinaintea acesteia, Curtea trebuie să stabilească în primul rând dacă reclamantul a respectat art. 35 din Convenție și, în special, termenul de șase luni stabilit prin art. 35 § 1 din Convenție. În special, Curtea constată că reclamantul se plânge în legătură cu condițiile de detenție inadecvate în care a îndeplinit sentința până la 24 ianuarie 2014. 35 § 1 din Convenție și trebuie respins în conformitate cu art. 35 § 4 din Convenție. Din aceste motive, Curtea, în unanimitate, declară cererea inadmisibilă. Eliberată în limba engleză și notificată în scris la 18 mai 2017. Karen Reid Vincent A. In the present application, having examined all the material before it, the Court must first determine whether the applicant complied with Article
35 of the Convention, and specifically with the six-month time-limit established by Article 35 § 1 of the Convention.
In particular, the Court notes that the applicant is complaining about inadequate conditions of detention in which he had served the sentence until 24
January 2014. The complaints were lodged with the Court on 8
January
2016.
In view of the above, the Court finds that these complaints are inadmissible for non-compliance with the six-month rule set out in Article
35 § 1 of the Convention and must be rejected in accordance with Article 35
For these reasons, the Court, unanimously,
Declares
the application inadmissible.
