Comunicat la 9 mai 2017 SEGUNDA SECȚIUNE Cerere nr. 5763/10 Ramazan ÇERİK și alții (a se vedea lista anexată) împotriva Turciei depusă la 24 decembrie 2009 OBIECTUL CAUZEI Cererea se referă la presupusa nedreptate a procedurii penale din cauza restricției sistemice impuse reclamanților dreptul de acces la un avocat în cursul fazei preliminare în temeiul Legii nr. 3842 și la utilizarea ulterioară de către instanța de judecată a acestor declarații luate în absența unui avocat (a se vedea Salduz c. Turcia [GC], nr. 36391/02, CEDH 2008, și İbrahim și alții c. Regatul Unit [GC], nr. 50541/08 și alții, CEDH 2016). Reclamanții au avut o audiere echitabilă în determinarea acuzațiilor penale împotriva acestora, în conformitate cu art. 6 § 1 din Convenție?

În special, a existat o încălcare a articolului 6 § 3 litera (c) din Convenție, ca urmare a lipsei de asistență juridică disponibilă reclamantului în cursul anchetei preliminare (a se vedea Salduz v. Turcia [GC], nr. 36391/02, CEDH 2008, și İbrahim și alții c. Regatul Unit [GC], nr. 50541/08 și altele 3 CEDH 2016)? Guvernul este invitat să prezinte copii ale tuturor documentelor relevante referitoare la cazul reclamanților, inclusiv, dar nu limitate la procesul-verbal al tuturor audierilor, hotărârile motivate ale instanței de judecată, dovezile documentare împotriva reclamanților, precum și depunerea scrisă a reclamanților și avocaților acestora pe parcursul procedurii.

SUBJECT MATTER OF THE CASE

The application concerns the alleged unfairness of the criminal proceedings due to the systemic restriction imposed on the applicants’ right of access to a lawyer during the pre-trial stage pursuant to Law no. 3842 and the subsequent use by the trial court of those statements taken in the absence of a lawyer (see Salduz v. Turkey [GC], no. 36391/02, ECHR 2008, and İbrahim and Others v. the United Kingdom [GC], nos. 50541/08 and 3 others, ECHR 2016). QUESTION tO THE PARTIES 1. Did the applicants have a fair hearing in the determination of the criminal charges against them, in accordance with Article 6 § 1 of the Convention? In particular, has there been a breach of Article 6 § 3 (c) of the Convention, as a result of the lack of legal assistance available to the applicant during the preliminary investigation (see Salduz v. Turkey [GC], no. 36391/02, ECHR 2008, and İbrahim and Others v. the United Kingdom [GC], nos.
