Cauza de la decizia 48302/15 Khaled BOUTAFFALA 27/06/2017 78398/13 Benoit DE MOFFARTS 27/06/2017 Comitetul de miniștri, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor aranjamente prietenoase așa cum apar în hotărârile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere că, în aceste cazuri, Curtea, după ce a luat notă oficială a unor aranjamente prietenoase atinse de guvernul statului în cauză și de solicitanți și a fost satisfăcută că aranjamentele s-au bazat pe respectarea drepturilor omului astfel cum au fost definite în Convenția sau în Protocolul său, a hotărât aceste cazuri din lista sa; având în vedere că condițiile unor aranjamente prietenoase au fost executate de guvernul statul intim, DECLARES că a exercitat, DECLARES a exercită și a exercitat funcțiile sale în conformitate cu art. 39 alineatul 4 din Convenția

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in these cases the Court, having taken formal note of the friendly settlements reached by the government of the respondent State and the applicants and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided to strike these cases from its list;

Having satisfied itself that the terms of the friendly settlements were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close their examination.
