Cauza de la Hotărârea 45285/09 MOSSOUX 05/11/2013 9772/10 ARSLAN 07/01/2014 Comitetul miniștrilor, în conformitate cu art. 39 alineatul (4) din Convenția pentru protecția drepturilor omului și a libertăților fundamentale, care prevede că Comitetul supraveghează executarea unor aranjamente prietenoase așa cum apar în deciziile Curții Europene a Drepturilor Omului (denumit în continuare „Convenția” și „Curtea”), având în vedere că, în aceste cazuri, Curtea, după ce a luat notă oficială de aranjamentele prietenoase atinse de guvernul statului respondent și de solicitanți și după ce a fost satisfăcută că aședițiile s-au bazat pe respectarea drepturilor omului astfel cum au fost definite în Convenția sau în Protocolul său, a decis să atace aceste cazuri din lista sa; având în vedere faptul că termenii de aranjamentele prietenoase au fost executate de guvernul statul pârât, DECLARES că a exercitat funcțiile sale în temeiul articolului 39 alineatul 4 al Convenției și al Convenției și DECIDESIDES.

The Committee of Ministers, under the terms of Article 39, paragraph 4, of the Convention for the Protection of Human Rights and Fundamental Freedoms, which provides that the Committee supervises the execution of friendly settlements as they appear in the decisions of the European Court of Human Rights (hereinafter “the Convention” and “the Court”),

Considering that in these cases the Court, having taken formal note of the friendly settlements reached by the government of the respondent State and the applicants and having been satisfied that the settlements were based on respect for human rights as defined in the Convention or its Protocols, decided to strike these cases from its list;

Having satisfied itself that the terms of the friendly settlements were executed by the government of the respondent State,

DECLARES that it has exercised its functions under Article 39, paragraph 4, of the Convention and

DECIDES to close their examination.
