Osma și alții împotriva Turciei

SEGUNDA SECȚIUNE DECIZIE Nr. 73706/14 Fadime OSMA și alții împotriva Turciei și a se vedea tabelul apendice (a se vedea tabelul apendice) Curtea Europeană a Drepturilor Omului (Secțiunea a doua), ședința la 13 septembrie 2018 în calitate de comitet compus din: Valeriu Grițco, președinte, Jon Fridrik Kjølbro, Stéphanie Mourou-Vikström, judecători și Liv Tigerstedt, grefier adjunct al secțiunii interioare; Având în vedere cererile depuse mai sus la diferitele date indicate în tabelul adăugat, având în vedere declarațiile prezentate de Guvernul contestat care solicită Curții să atace cererile din lista cazurilor, după deliberare, hotărăște după cum urmează: FACTE ȘI PROCEDIU Lista reclamanților este prezentată în tabelul adăugat.

Reclamanții au fost reprezentați de dl Adil Aktay și dl Uktu Çağrı Aktay, avocați care practică în Mersin. Reclamanții se plângeau de pierderea financiară pe care le-au suferit ca urmare a unei plăți întârziate a sumelor de expropiere, susținând că nu s-au aplicat niciun dobânzi sumelor acordate de instanțe interne. Se bazează pe art. 1 din Protocolul nr.1 la Convenție. Solicitațiile au fost comunicate guvernului turc („Guvernul”). Având în vedere subiectul similar al cererilor, Curtea consideră oportun să le examineze în comun într-o singură decizie. Guvernul a informat Curtea că propunea să facă declarații unilaterale în vederea soluționării problemelor legate de aceste plângeri și a solicitat, în continuare, Curtea să elimine cererile în conformitate cu art. 37 din Convenție.

Guvernul a recunoscut că neîndeplinirea instanțelor interne de a aplica orice dobânzi nejustificate pentru sumele respective de compensare constituie o sarcină excesivă pentru reclamanții și a încălcat dreptul la bucurarea pașnică a bunurilor lor, în lumina jurisprudenței Curții din Dökmeci c. Turcia , nr. 428/10, 6 decembrie 2016. Acestea au oferit reclamanților să plătească sumele detaliate în tabelul adăugat și au invitat Curtea să elimine cererile din lista cazurilor în conformitate cu art. 37 litera (c) din convenție. Sumele ar fi convertite în moneda statului interesat la rata aplicabilă la data plății și ar fi plătite în termen de trei luni de la data notificării hotărârii Curții.

În cazul în care nu s-au plătit aceste sume în termenul de trei luni menționat anterior, guvernul s-a angajat să plătească dobânzi simple pentru acestea, de la expirarea perioadei respective până la decontare, la o rată egală cu rata marginală de împrumut a Băncii Centrale Europene în timpul perioadei implicite plus trei puncte procentuale. Plata va constitui rezoluția finală a cazurilor. Reclamanții au fost trimiși termenii declarațiilor unilaterale ale Guvernului cu câteva săptămâni înainte de data prezentei decizii. Curtea nu a primit un răspuns din partea reclamanților care acceptă termenii declarațiilor. Curtea observă că art. 37 §§ § (c) îi permite să scoată un caz din lista sa dacă: „... din orice alt motiv stabilit de Curte, nu mai este justificat să continue examinarea cererii”.

Astfel, aceasta poate elimina cererile în temeiul articolului 37 § 1 litera (c) pe baza unei declarații unilaterale de către un guvern contestat, chiar dacă reclamanții doresc să continue examinarea cazurilor (a se vedea, în special, Tahsin Acar c. Turcia) (obiecții preliminare) [GC], nr. 26307/95, §§ 77, CEDO 2003-VI). Curtea a stabilit jurisprudența privind plângerile similare referitoare la drepturile de proprietate ale reclamanților în temeiul articolului 1 din Protocolul nr.1 la Convenție (a se vedea Dökmeci , citat mai sus).

Remarcarea admiterii conținute în declarațiile guvernamentale, precum și cuantumul compensației propuse – care este în conformitate cu sumele acordate în cazuri similare – consideră că nu mai este justificat continuarea examinării cererilor (art. 37 §§ §§ §§ §§ § )). Având în vedere considerentele de mai sus, Curtea este convinsă că respectarea drepturilor omului, astfel cum este definită în Convenție și în Protocolurile sale, nu impune ca aceasta să continue examinarea cererilor (art. 37 § în amendă În sfârșit, Curtea subliniază că, în cazul în care guvernul nu respectă termenii declarațiilor lor unilaterale, cererile pot fi restaurate pe listă în conformitate cu art. 37 § 2 din Convenție (Josipović c. Serbia (dec.), nr. 18369/07, 4 martie 2008). Având în vedere cele de mai sus, este necesar să se scoată din lista cazurile.

Din aceste motive, Curtea, în unanimitate, Decide să se alăture cererilor; ia act de termenii declarațiilor guvernului contestat și de modalitățile de asigurare a respectării întreprinderilor menționate în acest articol; decide să elimine cererile din lista sa de cazuri, în conformitate cu art. 37 § litera (c) din Convenție.

SECOND SECTION

DECISION Application no. 73706/14 Fadime OSMA and others against Turkey and 107 other applications (see appended table) The European Court of Human Rights (Second Section), sitting on 13 September 2018 as a Committee composed of: Valeriu Grițco, President, Jon Fridrik Kjølbro, Stéphanie Mourou-Vikström, judges, and Liv Tigerstedt, Acting Deputy Section Registrar, Having regard to the above applications lodged on the various dates indicated in the appended table, Having regard to the declarations submitted by the respondent Government requesting the Court to strike the applications out of the list of cases, Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appended table. The applicants were represented by Mr Adil Aktay and Mr Uktu Çağrı Aktay, lawyers practising in Mersin. The applicants complained about the financial loss they had suffered as a result of late payment of the expropriation amounts. In this connection, they maintained that no interest had been applied to the amounts awarded by the domestic courts. They relied on Article 1 of Protocol no.1 to the Convention. The applications were communicated to the Turkish Government (“the Government”). THE LAW Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.

After unsuccessful friendly-settlement negotiations, The Government informed the Court that they proposed to make unilateral declarations with a view to resolving the issues raised by these complaints. They further requested the Court to strike out the applications in accordance with Article 37 of the Convention. The Government acknowledged that the failure of the domestic courts to apply any default interest to the respective compensation amounts constituted an excessive burden on the applicants and breached their right to peaceful enjoyment of their possessions in the light of the Court’s case-law in Dökmeci v. Turkey , no. 428/10, 6 December 2016. They offered to pay the applicants the amounts detailed in the appended table and invited the Court to strike the applications out of the list of cases in accordance with Article 37 § 1 (c) of the Convention.

The amounts would be converted into the currency of the respondent State at the rate applicable on the date of payment, and would be payable within three months from the date of notification of the Court’s decision. In the event of failure to pay these amounts within the above-mentioned three-month period, the Government undertook to pay simple interest on them, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period plus three percentage points. The payment will constitute the final resolution of the cases. The applicants were sent the terms of the Government’s unilateral declarations several weeks before the date of this decision.

The Court has not received a response from the applicants accepting the terms of the declarations. The Court observes that Article 37 § 1 (c) enables it to strike a case out of its list if: “... for any other reason established by the Court, it is no longer justified to continue the examination of the application”. Thus, it may strike out applications under Article 37 § 1 (c) on the basis of a unilateral declaration by a respondent Government even if the applicants wish the examination of the cases to be continued (see, in particular, Tahsin Acar v. Turkey (preliminary objections) [GC], no. 26307/95, §§ 75 ‑ 77, ECHR 2003-VI). The Court has established case-law concerning similar complaints relating to the applicants’ property rights under Article 1 of Protocol no.1 to the Convention (see Dökmeci , cited above).

Noting the admission contained in the Government’s declarations as well as the amount of compensation proposed – which is consistent with the amounts awarded in similar cases – the Court considers that it is no longer justified to continue the examination of the applications (Article 37 § 1 (c)). In the light of the above considerations, the Court is satisfied that respect for human rights as defined in the Convention and the Protocols thereto does not require it to continue the examination of the applications (Article 37 § 1 in fine ). Finally, the Court emphasises that, should the Government fail to comply with the terms of their unilateral declarations, the applications may be restored to the list in accordance with Article 37 § 2 of the Convention ( Josipović v. Serbia (dec.), no. 18369/07, 4 March 2008). In view of the above, it is appropriate to strike the cases out of the list.

For these reasons, the Court, unanimously, Decides to join the applications; Takes note of the terms of the respondent Government’s declarations and of the arrangements for ensuring compliance with the undertakings referred to therein; Decides to strike the applications out of its list of cases in accordance with Article 37 § 1 (c) of the Convention.
