Comunicat la 4 decembrie 2018 CIFTH SECȚIUNE Cereri nr. 12693/18 și 14883/18 Melanie ANGERT și alții împotriva Germaniei și Sven RATIH împotriva Germaniei depuse la 8 martie 2018 și, respectiv, 21 martie 2018 OBIECTUL CAUZEI Cererea se referă la Legea privind uniformitatea acordurilor colective (Tarifeinheitsgesetz ), care reglementează conflictele care apar în cazul în care mai multe acorduri colective sunt aplicabile într-o societate. Actul prevede că, în cazul unui conflict, acordul colectiv al sindicatului care are mai puține membri într-o societate este înlocuit. Sindicatul al cărui acord colectiv este înlocuit are dreptul de a adopta acordul colectiv al sindicatului majoritar. În plus, dacă angajatorul se ocupă de negocieri colective, trebuie să informeze celelalte sindicate din societate și toate sindicatele au dreptul de a-și prezenta cererile angajatorului. Reclamanții sunt toate membrii unui sindicat german. A existat vreo interferență cu libertatea de asociere a reclamantului, în sensul articolului 11 § 1 din Convenție? SUBJECT MATTER OF THE CASE

The application concerns the Uniformity of Collective Agreements Act (

Tarifeinheitsgesetz

), which regulates conflicts that arise if several collective agreements are applicable in one company. The Act prescribes that, in case of a conflict, the collective agreement of the trade union which has fewer members in a company is superseded. The union whose collective agreement is superseded has the right to adopt the collective agreement of the majority union. Moreover, if the employer engages in collective bargaining, it has to inform the other trade unions in the company and all unions have the right to present their demands to the employer.

The applicants are all members of a German trade union.
